Many enforcement cooperation agreements provide for " positive comity " , under which each party's competition authority undertakes to consider requests by the other party to undertake enforcement action against anti-competitive practices in the requested country's territory that contravene the requested country's laws and adversely affect the requesting country's important interests.

Calls upon States to increase cooperation between competition authorities and Governments for the mutual benefit of all countries in order to strengthen effective international action against anti-competitive practices as covered by the Set, especially when these occur at the international level; such cooperation should take particular note of the needs of developing countries and economies in transition;

If a Party believes that anticompetitive practices carried out in the territory of the other Party adversely affect its important interests, the first Party may, after prior consultation with the other Party, request that the other Party's competition authorities initiate appropriate enforcement activities.
