The Committee recommends that the State party adopt the necessary measures to prevent, diminish and eliminate the conditions and attitudes which cause or perpetuate formal or de facto discrimination against Haitians and Dominicans of Haitian descent.

It regrets that five years after the judgment by the Inter-American Court of Human Rights in the Yean and Bosico case, children of Haitian descent born in the State party continue to suffer discrimination, in particular through the revocation of identity documents as a result of the application of Law No. 285-04 on Migration of 2004, Resolution No. 017 by the Dominican Electoral Board in 2007, and article 18.3 of the Constitution of 2010.
وتأسف لأنه رغم مرور 5 سنوات على الحكم الصادر عن محكمة البلدان الأمريكية لحقوق الإنسان في قضية يين وبوسيكو، فإن الأطفال المنحدرين من أصل هايتي لا يزالون يعانون من التمييز في الدولة الطرف، كما يدل على ذلك مثلاً إلغاء وثائق هويتهم نتيجة تطبيق قانون الهجرة رقم 285-04 لعـام 2004، والقرار رقم 017 الصادر عن المجلس الانتخابي الدومينيكي في عام 2007، والمادة 18-3 من دستور عام 2010.

44. In 2008, the independent expert on minority issues noted that people of Haitian descent living in the Dominican Republic constitute a minority group with rights, as elaborated in the Declaration on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities.
44- في عام 2008، أشار الخبير المستقل المعني بقضايا الأقليات إلى أن الأشخاص المنحدرين من أصل هايتي الذين يعيشون في الجمهورية الدومينيكية يشكلون أقلية لها حقوق، حسبما ورد بالتفصيل في إعلان حقوق الأشخاص المنتمين إلى أقليات قومية أو إثنية أو دينية ولغوية(119).

Included in that community are people of Haitian descent who have lived in the Dominican Republic for decades, as well as second and third generations born in the Dominican Republic when it was widely understood that the jus soli provision of the Dominican Constitution granted them citizenship.

The Committee is concerned that children in remote areas, Dominican-born children of Haitian descent and children of migrants continue to face difficulties in initial enrolment and access to education and that the overall quality and quantity of education is low, in particular among disadvantaged and marginalized groups and in rural areas, which issue is accompanied by a high rate of school dropouts and repetition.
293- ويساور اللجنة القلق لأن الأطفال في المناطق النائية، والأطفال الدومينيكيين المنحدرين من أصل هايتي وأطفال اللاجئين لا يزالون يواجهون صعوبات في الالتحاق بالمدرسة ونيل التعليم وأن التعليم الذي يتلقاه أفراد المجموعات المحرومة والمهمشة وفي المناطق الريفية بوجه الخصوص لا يرقى عموماً إلى المستوى المطلوب، كيفاً وكماً، وعموماً يفضي إلى ارتفاع معدلات التسرب والرسوب.

33. The Committee is concerned that children in remote areas, Dominican-born children of Haitian descent and children of migrants continue to face difficulties in initial enrolment and access to education and that the overall quality and quantity of education is low, in particular among disadvantaged and marginalized groups and in rural areas, which issue is accompanied by a high rate of school dropouts and repetition.
33- ويساور اللجنة القلق لأن الأطفال في المناطق النائية، والأطفال الدومينيكيين المنحدرين من أصل هايتي وأطفال اللاجئين لا يزالون يواجهون صعوبات في الالتحاق بالمدرسة ونيل التعليم وأن التعليم الذي يتلقاه أفراد المجموعات المحرومة والمهمشة وفي المناطق الريفية بوجه الخصوص لا يرقى عموماً إلى المستوى المطلوب، كيفاً وكماً، وعموماً يفضي إلى ارتفاع معدلات التسرب والرسوم.

The Committee also recommends that the State party take the necessary measures to guarantee that migrants and Dominican workers of Haitian origin have full opportunity to exercise their trade union rights in practice, and that they are protected from retaliation measures for exercising these rights.
كما توصي اللجنة الدولة الطرف باتخاذ التدابير اللازمة لضمان توفير فرص كاملة للعمال المهاجرين والعمال الدومينيكيين المنحدرين من أصل هايتي لممارسة حقوقهم النقابية ممارسة فعلية، وحمايتهم من تدابير الانتقام بسبب ممارستهم لهذه الحقوق.

23. The Committee is concerned at reports concerning children of Haitian origin born in the Dominican Republic who are deprived of access of official documentation on account of their origins (art. 24).
