100. The Special Rapporteur commends the mediators on the progress made in the peace process, particularly the establishment of some of the institutions provided for in the Arusha Agreement, and encourages them to continue their efforts to bring still recalcitrant groups to the negotiating table in order to achieve a negotiated solution to the conflict.
100- تهنّئ المقررة الخاصة الوسيط لما أحرزه من تقدم في عملية السلام وبوجه خاص في إقامة بعض المؤسسات المنصوص عليها في اتفاق أروشا وتشجعه على الاستمرار في بذل جهوده لحمل الأطراف التي لا تزال ممتنعة عن الجلوس إلى مائدة المفاوضات على القيام بذلك من أجل حل النزاع بطريق التفاوض.

(i) To assess the progress made towards the implementation of the judicial reforms provided for in the Arusha Agreement and the capacity of the Burundian judicial system, including its powers of investigation, to bring criminals to trial in an impartial and effective manner;

39. The legislative, judicial and institutional reforms provided for in the Arusha Agreement include the following:
39 - وتشمل الإصلاحات التشريعية والقضائية والمؤسسية المنصوص عليها في اتفاق أروشا() ما يلي:

34. Encourage the Government to make the best use of the Forum of Partners to support reforms provided for in the Arusha Agreement and to mobilize international assistance for the reconstruction of Burundi.
34 - تشجيع الحكومة على الاستفادة المثلى من منتدى الشركاء لدعم الإصلاحات المنصوص عليها في اتفاق أروشا وحشد المساعدة الدولية لتعمير بوروندي.

2. Supports the transitional institutions set up in the context of the implementation of the Arusha Agreement, namely, the Transitional National Assembly, the Transitional Senate as well as the Transitional Government, and encourages the implementation of the reforms provided for in the Arusha Agreement in a spirit of national unity and mutual confidence;
2- تؤيد المؤسسات الانتقالية التي أقيمت في إطار تطبيق اتفاق أروشا، وهي الجمعية الوطنية الانتقالية، ومجلس الشيوخ الانتقالي، والحكومة الانتقالية، وتشجّع على تنفيذ الإصلاحات المنصوص عليها في اتفاق أروشا بروح الوحدة الوطنية والثقة المتبادلة؛

38. In accordance with its mandate, the mission assessed the progress made towards implementation of the judicial reforms provided for in the Arusha Agreement and the capacity of the Burundian judicial system to bring to trial those responsible for the crimes of genocide, crimes against humanity and war crimes in an impartial, fair and effective manner.
38 - أجـرت البعثـة وفقـا لولايتهـا تقييما للتقدم المحرز صـوب تطبيق الإصلاحات القضائية المنصوص عليها في اتفاق أروشا وقدرات الجهاز القضائي البوروندي علـى محاكمـة المسؤولين عن جرائم الإبادة الجماعية والجرائم المرتكبة ضد الإنسانية وجرائم الحرب بطريقة نزيهة وعادلة وفعالة.
