While taking into account the importance conferred by the Federal Constitution on the freedoms of expression and assembly, the Committee recalls that freedom of expression and assembly is not absolute and that the establishment and activities of organizations promoting or inciting racism and racial discrimination shall be prohibited.

327. The Committee also notes with concern that article 4 of the Convention has not yet been fully implemented, since the law of the Republic of Korea contains no provisions explicitly punishing acts of racial discrimination and prohibiting organizations which promote and encourage racial discrimination.
٣٢٧ - وتلاحظ اللجنة مع القلق أيضا أن المادة ٤ من الاتفاقية لم تنفذ بعد تنفيذا تاما نظرا إلى أن قانون جمهورية كوريا لا يتضمن أي أحكام تنص صراحة على المعاقبة على أعمال التمييز العنصري وعلى حظر المنظمات التي تروج للتمييز العنصري وتشجع عليه.

333. The Committee also underlines the compulsory nature of the provisions of article 4 of the Convention and recommends that the State Party adopt appropriate legislation to give effect to those provisions, particularly by enacting a law explicitly prohibiting and punishing acts of racial discrimination and organizations which promote and encourage racial discrimination.
٣٣٣ - وتؤكد اللجنة كذلك على الطابع اﻹلزامي ﻷحكام المادة ٤ من الاتفاقية، وتوصي باعتماد الدولة الطرف التشريعات المناسبة ﻹنفاذ تلك اﻷحكام، ولا سيما بسن قانون ينص صراحة على حظر أعمال التمييز العنصري والمعاقبة عليها وحظر ومعاقبة المنظمات التي تروج للتمييز العنصري وتشجع عليه.

The Committee also recommends that the Government provide in its next periodic report information, including the number of complaints lodged and sentences passed, about the implementation in practice of the legal provisions prohibiting acts of racial discrimination and organizations which promote and incite racial discrimination, in accordance with articles 2 and 4 of the Convention.
٣٦٨ - وتوصي اللجنة أيضا بأن تقدم الحكومة في تقريرها الدوري التالي معلومات عن التنفيذ الفعلي لﻷحكام القانونية التي تحظر أعمال التمييز العنصري، وعن المنظمات التي تروج للتمييز العنصري وتحرض عليه وفقا للمادتين ٢ و ٤ من الاتفاقية، وأن تشمل تلك المعلومات عدد الشكاوى المرفوعة واﻷحكام الصادرة.

606. Concern is expressed that the State party has not taken all appropriate measures to prohibit organizations which promote and incite racial discrimination, in accordance with article 4 (b) of the Convention.
٦٠٦ - وأُعرب عن القلق ﻷن الدولة الطرف لم تتخذ كل التدابير المناسبة، طبقا للمادة ٤ )ب( من الاتفاقية، لحظر المنظمات التي تروج التمييز العنصري وتحرض عليه.

Furthermore, the Committee notes that the State party has only declared punishable active participation in organizations promoting and inciting racial discrimination.
382- كما تلاحظ اللجنة أن الدولة الطرف لم تبوب ضمن الأعمال التي يعاقب عليها القانون سوى المشاركة النشطة في المنظمات التي تروج للتمييز العنصري وتحرض عليه.

In this respect, the Committee draws the State party's attention to its general recommendation XV according to which all provisions of article 4 of the Convention are of a mandatory character, including declaring illegal and prohibiting all organizations promoting and inciting racial discrimination.
وفي هذا الصدد، تسترعي اللجنة انتباه الدولة الطرف إلى توصيتها العامة الخامسة عشرة التي تنص على أن كل الأحكام الواردة في المادة 4 من الاتفاقية هي ذات طابع إلزامي، بما فيها حظر المنظمات التي تروج للتمييز العنصري وتحرض عليه وإعلانها منظمات غير قانونية.

483. With regard to the implementation of article 4 of the Convention, the members of the Committee asked what the exact scope of the reform of the Criminal Code would be and whether the new provisions would make it possible to dissolve organizations that promoted racism and to punish the persons responsible, in accordance with the provisions of article 4 (b) of the Convention.
٣٨٤ - وفيما يتعلق بتنفيذ المادة ٤ من الاتفاقية، سأل أعضاء اللجنة ما هو بالضبط مدى إصلاح القانون الجنائي وما إذا كانت اﻷحكام الجديدة ستمكن من حل المنظمات التي تروج للعنصرية ومعاقبة اﻷشخاص المسؤولين، وفقا ﻷحكام المادة ٤ )ب( من الاتفاقية.
