51. In closing, she reiterated her delegation’s position that prevention and liability were a continuum which began with the duty to assess the risk of significant transboundary harm and ended with the obligation to ensure compensation if such harm occurred.
٥١ - وفي الختام كررت موقف وفدها بأن المنع والمسؤولية هما سلسلة متصلة تبدأ بواجب تقييم مخاطر الضرر الجسيم العابر للحدود وتنتهي بالالتزام بكفالة دفع تعويض إذا حدث الضرر.

19. With regard to international liability for injurious consequences arising out of acts not prohibited by international law, his delegation commended the Working Group for recognizing the need to strike a balance between prevention and liability.

3. With regard to the complex topic of international liability for injurious consequences arising out of acts not prohibited by international law, which had been on the agenda for a quarter of a century, the narrower, step-by-step approach of dividing the topic into the prevention and liability aspects had finally allowed the Commission to make significant progress.

8. Separation also had the effect of determining the consequences of liability at a time when the Commission was meant to be dealing solely with prevention and thus distorted the decision taken at the forty-ninth session that the issues of prevention and liability should be dealt with separately.
٨ - وللفصل أيضا أثر في تقرير نتائج المسؤولية في الوقت الذي يفترض فيه أن تتناول اللجنة موضوع المنع وحده، وبذلك يشوه القرار الذي اتخذ في الدورة التاسعة واﻷربعين بأنه ينبغي أن يتم تناول مسائل المنع والمسؤولية بصورة منفصلة.

49. With respect to the form which the draft articles would take, her delegation was in favour of incorporating articles on both prevention and liability in a convention which would lay down residual rules of international law but allow States, by mutual agreement, to add or substitute more detailed regimes to govern particular activities.

7. As to the two aspects of the topic, “prevention” and “international liability”, the Working Group felt that they were distinct from one another, though related. Accordingly, it proposed that issues of prevention and liability should be dealt with separately.
٧ - وفيما يتعلق بجانبي الموضوع، أي " المنع " و " المسؤولية الدولية " ، ارتأى الفريق العامل أن هاتين المسألتين متميزة إحداهما عن اﻷخرى، وإن كانت لكل منهما صلة باﻷخرى، ولذلك اتفق الفريق العامل على وجوب معالجة مسألتي المنع والمسؤولية كل على حدة.

These were: (a) State liability, (b) scope of activities, (c) threshold of damage covered and (d) linkage between prevention and liability. 1. State liability: a case of misplaced emphasis
وهذه الجوانب الأربعة هي: (أ) مسؤولية الدولة، (ب) ونطاق الأنشطة، (ج) والحد الأدنى للضرر المشمول، (د) والربط بين المنع والمسؤولية.

The Commission resumed its work on the issue of liability with respect to transboundary harm in 2002, " bearing in mind the interrelationship between prevention and liability " .

10. Mr. Al-Baharna (Bahrain), speaking on the topic of international liability, said that many conflicting views on prevention and liability had been expressed since the emergence of the topic in 1978, unfortunately without conclusive results.
10 - السيد البحارنة (البحرين): تكلم في موضوع المسؤولية الدولية، فقال إن الكثير من الآراء المتضاربة في المنع والمسؤولية قد أعرب عنها منذ خروج الموضوع إلى الوجود في عام 1978، ولكن دون الخلوص إلى نتائج حاسمة للأسف.

5. The report of the Working Group contained a complete picture of the topic relating to the principles of prevention and of liability for compensation or other relief along with draft articles and commentaries thereto.
