Article 68. Actions against the maritime performing party
المادة 68- رفع الدعاوى على الطرف المنفِّذ البحري

The plaintiff has the right to institute judicial proceedings under this Convention against the maritime performing party in a competent court within the jurisdiction of which is situated one of the following places:
يحق للمدّعي أن يرفع دعوى قضائية بمقتضى هذه الاتفاقية على الطرف المنفِّذ البحري أمام محكمة مختصة يقع ضمن نطاق ولايتها أحد المكانين التاليين:

Notwithstanding article 79 and without prejudice to article 80, the contract of carriage may exclude or limit the obligations or the liability of both the carrier and a maritime performing party if:

7. " maritime performing party " means a performing party to the extent that it performs or undertakes to perform any of the carrier's obligations during the period between the arrival of the goods at the port of loading of a ship and their departure from the port of discharge of a ship.
7- " الطرف المنفِّذ البحري " يعني أيَّ طرف منفِّذ، ما دام يؤدي، أو يتعهد بأن يؤدي، أيّا من واجبات الناقل أثناء فترة ما بين وصول البضاعة إلى ميناء تحميل السفينة ومغادرتها ميناء تفريغ السفينة.

(c) Employees of the carrier or a maritime performing party.
(ج) مستخدمين لدى الناقل أو الطرف المنفِّذ البحري.

1. A maritime performing party is subject to the obligations and liabilities imposed on the carrier under this Convention and is entitled to the carrier's defences and limits of liability as provided for in this Convention if:
1- يتحمّل الطرف المنفِّذ البحري الواجبات والمسؤوليات الملقاة على عاتق الناقل بمقتضى هذه الاتفاقية، ويحق لـه التمتّع بالدفوع وحدود المسؤولية المتاحة للناقل حسبما تنص عليه هذه الاتفاقية إذا:

4. Nothing in this Convention imposes liability on the master or crew of the ship or on an employee of the carrier or of a maritime performing party.
٤- ليس في هذه الاتفاقية ما يلقي المسؤولية على عاتق رُبّان السفينة أو طاقمها أو على عاتق أحد مستخدَمي الناقل أو الطرف المنفِّذ البحري.

Deviation When pursuant to applicable law a deviation constitutes a breach of the carrier's obligations, such deviation of itself shall not deprive the carrier or a maritime performing party of any defence or limitation of this Convention, except to the extent provided in article 61.
عندما يقضي القانون المنطبق بأن الانحراف عن المسار يشكّل إخلالا بواجبات الناقل، لا يحرم هذا الانحراف عن المسار في حد ذاته الناقل أو الطرف المنفِّذ البحري من أي وسيلة دفاع أو حد من المسؤولية بمقتضى هذه الاتفاقية، باستثناء ما هو منصوص عليه في المادة ٦1.

(e) A proposal of the Government of the United States of America on the definition of " maritime performing party " (A/CN.9/WG.III/WP.84);
(ﻫ) اقتراح من حكومة الولايات المتحدة الأمريكية بشأن تعريف " الطرف المنفِّذ البحري " (A/CN.9/WG.III/WP.84)؛

(a) The maritime performing party received the goods for carriage in a Contracting State, or delivered them in a Contracting State, or performed its activities with respect to the goods in a port in a Contracting State; and
(أ) تسلَّم الطرف المنفِّذ البحري البضاعة بغرض نقلها في دولة متعاقدة أو سلَّم البضاعة في دولة متعاقدة أو نفّذ أنشطته المتعلقة بالبضاعة في ميناء واقع في دولة متعاقدة؛

2. If the carrier agrees to assume obligations other than those imposed on the carrier under this Convention, or agrees that the limits of its liability are higher than the limits specified under this Convention, a maritime performing party is not bound by this agreement unless it expressly agrees to accept such obligations or such higher limits.
2- إذا وافق الناقل على تحمل واجبات غير تلك المفروضة عليه بمقتضى هذه الاتفاقية، أو وافق على أن تتجاوز حدود مسؤوليته الحــدود المنصوص عليها في هذه الاتفاقية، لا يكون الطرف المنفِّذ البحري ملزما بهذه الموافقة ما لم يوافق صراحة على قبول تلك الواجبات أو تلك الحدود الأعلى.

3. A maritime performing party is liable for the breach of its obligations under this Convention caused by the acts or omissions of any person to which it has entrusted the performance of any of the carrier's obligations under the contract of carriage under the conditions set out in paragraph 1 of this article.
٣- يكون الطرف المنفِّذ البحري مسؤولاً عن الإخلال بواجباته بمقتضى هذه الاتفاقية بسبب أفعال أو إغفالات أي شخص كان قد عَهِد إليه بأداء أي من واجبات الناقل بمقتضى عقد النقل، وفقا للشروط المبيّنة في الفقرة 1 من هذه المادة.

3. The notice referred to in this article is not required in respect of loss or damage that is ascertained in a joint inspection of the goods by the person to which they have been delivered and the carrier or the maritime performing party against which liability is being asserted.
٣- لا يلزم توجيه الإشعار المشار إليه في هذه المادة فيما يتعلق بالهلاك أو التلف الذي يؤكَّد حدوثه في تفقّد مشترك للبضاعة من جانب الشخص الذي سُلِّمت إليه والناقل أو الطرف المنفِّذ البحري الذي يجري تأكيد المسؤولية تجاهه.

5. When the notice referred to in this article is given to the performing party that delivered the goods, it has the same effect as if that notice was given to the carrier, and notice given to the carrier has the same effect as a notice given to a maritime performing party.
5- عندما يوجَّه الإشعار المشار إليه في هذه المادة إلى الطرف المنفِّذ الذي سلَّم البضاعة، يكون لـه نفس المفعول كما لو كان قد وجِّه إلى الناقل، ويكون للإشعار الموجّه إلى الناقل نفس مفعول الإشعار الموجّه إلى الطرف المنفِّذ البحري.

(b) The port where the goods are received by the maritime performing party, the port where the goods are delivered by the maritime performing party or the port in which the maritime performing party performs its activities with respect to the goods.
(ب) الميناء الذي يتسلَّم فيه الطرف المنفِّذ البحري البضاعة، أو الميناء الذي يسلّم فيه الطرف المنفِّذ البحري البضاعة، أو الميناء الذي يقوم فيه الطرف المنفِّذ البحري بأنشطته فيما يتعلق بالبضاعة.

1. Except when there is an exclusive choice of court agreement that is binding pursuant to articles 67 or 72, if a single action is brought against both the carrier and the maritime performing party arising out of a single occurrence, the action may be instituted only in a court designated pursuant to both article 66 and article 68.
1- باستثناء الحالة التي يوجد فيها اتفاق على اختيار حصري للمحكمة ويكون ذلك الاتفاق ملزما بمقتضى المادة 67 أو المادة 72، إذا رُفعت على الناقل والطرف المنفِّذ البحري كليهما دعوى واحدة ناشئة عن حدث واحد، لا يجوز رفع تلك الدعوى إلا أمام محكمة مسماة بمقتضى المادتين ٦6 و68 كلتيهما.

(a) Directly or indirectly excludes or limits the obligations of the carrier or a maritime performing party under this Convention;
(أ) يستبعد واجبات الناقل أو الطرف المنفِّذ البحري المنصوص عليها في هذه الاتفاقية أو يحدّ منها، بصورة مباشرة أو غير مباشرة؛ أو

(b) Directly or indirectly excludes or limits the liability of the carrier or a maritime performing party for breach of an obligation under this Convention; or
(ب) يستبعد مسؤولية الناقل أو الطرف المنفِّذ البحري عن الإخلال بواجب منصوص عليه في هذه الاتفاقية أو يحدّ منها، بصورة مباشرة أو غير مباشرة؛ أو
