248. The Court went on to consider whether on the facts a State of necessity existed. It evaluated the matter in the light of the criteria laid down by the International Law Commission in its draft articles on international responsibility of States for internationally wrongful acts.

V). It was important to understand the basis for the use of that term.

111. The work of the International Law Commission on the matter of the scope of the draft articles on international liability arising out of acts not prohibited by international law has culminated in some important conclusions on the activities to be covered, on the threshold of harm or damage required for triggering the obligation and on specifying or clarifying the concept of “transboundary damage”.

In paragraph 3 of the resolution, the Assembly drew the attention of Governments to the importance, for the Commission, of having their views on the draft articles on international liability for injurious consequences arising out of acts not prohibited by international law (prevention of transboundary damage from hazardous activities) as referred to the Drafting Committee.
