II. Comments and observations received from Governments on the draft articles on nationality of natural persons in relation to the succession of States
ثانيا - التعليقات والملاحظـات الواردة مــن الحكومات بشــأن مشـروع المواد المتعلقة بجنسية اﻷشخاص الطبيعيين فيما يتصل بخلافة الدول

Upon subsequent finalization, and adoption by the General Assembly, the draft articles on nationality of natural persons in relation to the succession of States will constitute a timely contribution to the development of norms in this notoriously difficult field of law.

The wording of the draft articles on nationality of natural persons in relation to the succession of States emphasized the generally accepted principle that the succession of States should not render natural persons stateless, and his delegation supported the recommendation that the General Assembly should adopt the draft articles in the form of a declaration.
٣١ - وقال إن صياغة مشاريع المواد المتعلقة بجنسية اﻷشخاص الطبيعيين فيما يتصل بخلافة الدول تؤكد المبدأ المقبول عموما وهو أن خلافة الدول لا ينبغي أن تتسبب في انعدام الجنسية لﻷشخاص الطبيعيين. وقال إن وفده يؤيد التوصية بضرورة أن تعتمد الجمعية العامة مشاريع المواد في شكل إعلان.

42. Mr. Hwang Yong-shik (Republic of Korea) said that his delegation supported the content of the draft articles on nationality of natural persons in relation to succession of States, which reflected the general principles of existing international law.
٤٢ - السيد هوانغ يونغ شيك )جمهورية كوريا(: قال إن وفده يؤيد مضمون مشاريع المواد المتعلقة بجنسية اﻷشخاص الطبيعيين فيما يتصل بخلافة الدول والتي تعكس المبادئ العامة للقانون الدولي الحالي.

40. The Commission further wishes to reiterate its request to Governments for written comments and observations on the draft articles on nationality of natural persons in relation to the succession of States adopted on first reading in 1997, so as to enable it to begin the second reading of the draft articles at its next session.

28. Mr. Beranek (Czech Republic) said that the decision to present the draft articles on nationality of natural persons in relation to the succession of States in the form of a draft declaration was perhaps the most practical method of providing States involved in a succession with a set of legal principles and recommendations for drafting their nationality legislation.
٢٨ - السيد بيرانك )الجمهورية التشيكية(: استهل بقوله إن إقرار تقديم مشروع المواد المتعلقة بجنسية اﻷشخاص الطبيعيين في حالة خلافة الدول في صيغة مشروع إعلان، ربما كان أفضل الوسائل العملية لتوفير مجموعة من المبادئ والتوصيات القانونية للدول المعنية بالخلافة للاستعانة بها في وضع تشريعاتها الوطنية.

In its resolution 10/13, the Human Rights Council recalled General Assembly resolutions 55/153 and 59/34, in which the Assembly invited Member States to take into account the provisions of the draft articles on the nationality of natural persons contained in the annex to Council resolution 55/153 in dealing with issues of nationality in relation to the succession of States.
وذكّر مجلس حقوق الإنسان في قراره 10/13 بقراري الجمعية العامة 55/153 و59/34 اللذين دعت فيهما الدول الأعضاء إلى مراعاة أحكام مشروع المواد المتعلقة بجنسية الأشخاص الطبيعيين الواردة في مرفق قرار المجلس 55/153 عند تناول قضايا الجنسية في حالة خلافة الدول.

Uruguay, having taken note of the annex [to resolution 55/153] containing draft articles on the nationality of natural persons in relation to the succession of States, has no further comments to submit thereon, as it considers it advisable to retain that text, which compiles the relevant existing standards.

16. Mr. Winkler (Austria), referring to chapter IV of the Commission’s report, said that his delegation had noted with satisfaction the final text of the draft articles on the nationality of natural persons in relation to the succession of States adopted on second reading.

For instance, in its commentary on article 9 of the draft articles on the nationality of natural persons, the Commission expressed its concern " with the risk of statelessness related to the ... requirement of prior renunciation of another nationality " .

55. Considering the detrimental impact that State succession may have on, inter alia, the right to a nationality, article 18 of the draft articles on the nationality of natural persons provides that States concerned should exchange information and consult to identify such effects and, when necessary, eliminate or mitigate such effects through negotiation.
