It may be recalled that article 16 of the draft articles on prevention provides for a similar obligation for States in respect of the claims which may arise during the phase of prevention, a phase in which States are obliged to manage the risk involved in the hazardous activities with all due diligence.

The latter part of the paragraph reads " its territory or otherwise under its jurisdiction or control " and the terminology is the same as used in paragraph 1 (a) of article 6 of the draft articles on prevention.
والجزء الأخير من الفقرة جاء فيه: " داخل إقليمها أو في أماكن تخضع على نحو آخر لولايتها أو سيطرتها " ، والمصطلحات المستخدمة هي نفس المصطلحات المستخدمة في الفقرة 1(أ) من المادة 6 من مشاريع المواد بشأن المنع.

11. Mr. Rao (Special Rapporteur, International Law Commission), bringing to a close the discussion on international liability for injurious consequences arising out of acts not prohibited by international law, said that as Special Rapporteur, he had to work along the lines indicated by the Commission and the Committee, and thus to conclude the elaboration of draft articles on prevention.
