27. The United Nations human rights treaty bodies continued to address the question of the death penalty, in concluding observations following examination of State party reports and when considering individual communications.

In its general comment No. 33, the Committee had stated that, although its function in considering individual communications was not that of a judicial body, the Views issued exhibited some important characteristics of a judicial decision.

In particular, the consideration of individual communications by United Nations treaty bodies has provided an avenue for remedy for indigenous peoples, the challenges that this has created for the treaty bodies notwithstanding.

It would be most unfortunate if the general comment placed any limitations on that standard, as that could hinder the Committee in its monitoring of States parties' implementation of the Covenant in the sensitive area of freedom of expression and its consideration of individual communications.

18. The Human Rights Committee continues to address the question of the death penalty under the ICCPR in both concluding observations following examination of State party reports and in considering individual communications under the First Optional Protocol to the Covenant.

" 5. The working group considers that for the purpose of discharging their functions, treaty bodies are competent to assess the validity of reservations and, in the event, the implications of a finding of invalidity of a reservation, particularly in the examination of individual communications or in exercising other fact-finding functions in the case of treaty bodies that have such competence.

39. In each case, and having ratified the relevant Optional Protocols, Portugal recognises the full range of the Committees' competences to monitor the implementation of these core international human rights treaties, including the powers to examine individual and inter-State communications, and to undertake inquiry procedures.
