Concerns over such monopolistic tendencies of technology suppliers in developing countries provide justification for a greater regulation on international technology transfer in the interests of these countries, in accordance with their national objectives and priorities.

61. The TRIPS Agreement recognizes as a principle (art. 8) that appropriate measures, provided they are consistent with the provisions of the Agreement, may be needed to prevent the abuse of intellectual property rights by right holders or the resort to practices which unreasonably restrain trade or adversely affect the international transfer of technology.
١٦- تعترف اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية كمبدأ )المادة ٨( بأنه قد تكون هناك حاجة لاتخاذ تدابير، يشترط اتساقها مع أحكام الاتفاق الحالي، لمنع حائزي حقوق الملكية الفكرية من إساءة استخدامها، أو منع اللجوء إلى ممارسات تسفر عن تقييد غير معقول للتجارة أو تؤثر سلبا على النقل الدولي للتكنولوجيا.

60. This uniqueness arises, in particular, from the effect of such developments on international technology transfer which calls on the international community in the new economic environment to identify new parameters for a healthy competition that would be valid for all parties in an integrated world market.
وينبع هذا التفرد بصفة خاصة من أثر هذه التطورات على النقل الدولي للتكنولوجيا الذي يدعو المجتمع الدولي في البيئة الاقتصادية الجديدة إلى تعيين بارامترات جديدة من أجل قيام منافسة صحية تصلح لجميع اﻷطراف في سوق عالمية متكاملة.
