We are gratified by the provision that nothing contained in the Declaration may be construed as authorizing or encouraging any action which dismembers or impairs, totally or in part, the territorial integrity or political unity of sovereign and independent States.

The Vienna Declaration clearly stated that self-determination should not be construed as authorizing or encouraging any action which would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States.
ويذكر إعلان فيينا بوضوح أنه لا ينبغي تفسير تقرير المصير على أنه يأذن أو يشجع أي إجراء من شأنه أن يمزق أو يضعف، كليا أو جزئيا، السلامة اﻹقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة.

The 1970 Declaration on Principles of International Law provided that the right to self-determination should not be construed as authorizing or encouraging any action which would dismember or impair the territorial integrity or political unity of sovereign and independent States and that the principles set forth in the Declaration were interrelated.
وينص اﻹعلان المتعلق بمبادئ القانون الدولي لعام ١٩٧٠ على أن الحق في تقرير المصير لا ينبغي أن يؤول على أنه يأذن أو يشجع على اتخاذ أي إجراء يؤدي إلى تفكيك أو إضعاف السلامة اﻹقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة كما ينص على أن المبادئ الواردة في اﻹعلان مترابطة.

Furthermore, the seventh paragraph of that section contains a requirement for every State to refrain from any action which would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States.

ولا يجوز أن يؤوَل ذلك على أنه يرخص بأي عمل أو يشجع على أي عمل من شأنه أن يمزق أو يخل جزئيا أو كليا بالسلامة الإقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة التي تلتزم في تصرفاﺗﻬا مبدأ تساوي الشعوب في الحقوق وحقها في تقرير مصيرها بنفسها؛

This shall not be construed as authorizing or encouraging any action that would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States conducting themselves in compliance with the principle of equal rights and self-determination of peoples and thus possessed of a Government representing the whole people belonging to the territory without distinction of any kind.
وينبغي ألا يفسر هذا على أنه يأذن أو يشجع على القيام بأي عمل من شأنه أن ينتقص أو ينال، كليا أو جزئيا، من السلامة اﻹقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة التي تتصرف وفقا لمبدأ تكافؤ الحقوق بين الشعوب وتقرير مصيرها، وبالتالي لديها حكومة تمثل كل الشعب الذي ينتمي إلى اﻹقليم دون تمييز من أي نوع.

The Vienna Declaration also indicated that the right of self-determination could not be construed as authorizing or encouraging any action which would dismember or impair the territorial integrity or political unity of sovereign and independent States which complied with the principle of equal rights and were possessed of a Government representing the whole people belonging to the territory.
٦٢ - وقال إن إعلان فيينا بيﱠن أيضا أنه لا يمكن تفسير حق تقرير المصير بأنه يأذن أو يشجع أي إجراء من شأنه أن يمزق أو يضعف السلامة اﻹقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة التي تمتثل لمبدأ التساوي في الحقوق ولديها حكومات تمثل جميع طوائف الشعب الذي ينتمي لﻹقليم.

40. Paragraph 2 of the report went on to state that international law recognized that the principle of self-determination could not be " construed as authorizing any action which would dismember or impair totally or in part the territorial integrity or political unity of sovereign and independent States " .
٠٤- وتمضي الفقرة ٢ من التقرير في ذكر أن القانون الدولي يعترف بأنه لا يجوز " أن يفسر مبدأ تقرير المصير بأنه يسمح بأي إجراء من شأنه أن يمزق أو يضعف كلياً أو جزئياً السلامة الاقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة " .

In the same vein, the 1993 Vienna Declaration and Programme of Action had reaffirmed the idea that self-determination should not be construed as authorizing or encouraging any action which would impair the territorial integrity or political unity of sovereign and independent States, and had underscored the interdependent, mutually reinforcing nature of democracy, development and respect for human rights.
وذكر في السياق ذاته أن إعلان وبرنامج عمل فيينا لعام 1993 قد أكد من جديد الرأي القائل بأن تقرير المصير ينبغي أن لا يُفسر على أنه يسمح أو يشجع على اتخاذ أي إجراءٍ من شأنه أن ينتقص من السلامة الإقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة. وشدد على ترابط وتعاضد الديمقراطية والتنمية واحترام حقوق الإنسان.

Cuba considered the concerns of some States with respect to selfdetermination as unfounded, given that it is clearly expressed in this declaration that nothing in it shall be construed as authorizing or encouraging any action which would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States.
وبيَّن أن كوبا ترى أن ما يساور بعض الدول من قلق بشأن تقرير المصير لا أساس له، حيث إن الإعلان المذكور ينص بوضوح على أنه لا يجوز تأويل أي شيء مما ورد فيه على أنه يُرَخِّص بأي عمل أو يشجع على أي عمل من شأنه أن يمزق أو يُخِل، جزئياً أو كلياً، بالسلامة الإقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة.

The right to self-determination should not however be construed as authorizing or encouraging any action which would impair the territorial integrity or political unity of sovereign and independent States conducting themselves in compliance with the principle of equal rights and self-determination of peoples and led by a Government representing the population as a whole, without distinction of any kind.
بيد أن الحق في تقرير المصير لا ينبغي أن يفسر بأنه يأذن بأي إجراء أو يشجع على اتخاذ أي إجراء من شأنه إلحاق الضرر بالسلامة اﻹقليمية أو الوحدة السياسية للدول المستقلة ذات السيادة التي تسير أمورها امتثالا لمبادئ المساواة في الحقوق وحق الشعوب في تقرير المصير والتي تقودها حكومة تمثل السكان ككل دون تمييز من أي نوع.

" Nothing in the foregoing paragraphs shall be construed as authorizing or encouraging any action which would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States. " (Emphasis added.)

In addition, article 46 states clearly that nothing in the Declaration may be interpreted as implying for any State, people, group or person any right to engage in any activity or to perform any act contrary to the United Nations Charter or construed as authorizing or encouraging any action that would dismember or impair, totally or in part, the territorial integrity or political unity of sovereign and independent States.

27. Mr. Tulbure (Moldova) said that, while the right of peoples to self-determination was a universally recognized principle of international law, the Vienna Declaration stipulated that self-determination should not be perceived as authorizing or encouraging any action which would impair the territorial integrity or political unity of sovereign and independent States.
