111. The child has the same right as any citizen to lodge a complaint with the courts about dispositions made by the guardian or legal guardian that conflict with the interest of the child.
111- أن للطفل أو أي مواطن الحق في اللجوء للقضاء شاكياً من تصرفات الولي أو الوصي لتعارضها مع مصلحة الطفل.

110. The judge acts as guardian for any person who is without a guardian and he is the competent authority for dealing with complaints about a guardian's arbitrary conduct. Where the interest of the guardian or legal guardian conflicts with that of the minor, the judge appoints a person to represent the minor.
110- أن القاضي هو ولي من لا ولي لـه، وهو المرجع في الشكوى من تعسف الولي، وأنه عند تعارض مصلحة الولي أو الوصي مع القاصر يعين القاضي ممثلاً خاصاً له.

Any measures taken against a minor without the appointment of such a guardian are deemed invalid. Similarly, a minor having attained 15 years of age may, before he reaches the full legal age of 18, administer his property with the permission of his guardian or tutor, provided that he first obtains leave to do so from the court.
فإذا اتخذت إجراءات في مواجهة القاصر دون تعيين ولي الخصومة تعتبر تلك الإجراءات باطلة، كما أن للقاصر بعد إكمال الخامسة عشرة وقبل بلوغ الثامنة عشرة، أي سن الرشد، إدارة ماله ويكون الإذن من الولي أو الوصي بعد موافقة المحكمة على ذلك.

44. The Personal Status Code regulates the procedure for administering and supervising a minor's property. It stipulates that the legal guardian or tutor has a responsibility to protect such property, that he may not make a donation or gift thereof, and that he has an obligation to preserve it.
44- وقد نظم قانون الأحوال الشخصية كيفية إدارة أموال الطفل والمحافظة عليها ومساءلة الولي أو الوصي عن هذه الأموال والحفاظ عليها بحيث منعه من التبرع أو الهبة من مال القاصر.

According to the provisions of article 274 of the Code of Criminal Procedures, and within the meaning of article 39 of the Juveniles Act, if the minor is poor or the guardian or tutor has failed to engage a lawyer, the court must adjourn its hearing until a defence lawyer has been appointed, in cooperation with the Bar Association, to act on the young person's behalf.
وإذا كان الحدث فقيراً أو امتنع الولي أو الوصي الغني عن توكيل محامٍ، فإن المحكمة تؤجل الاستماع إلى الحدث إلى أن يتم توكيل محامٍ مسخر للدفاع عنه وذلك بالتعاون مع نقابة المحامين. عملاً بأحكام المادة 274 من قانون أصول المحاكمات الجزائية، وبدلالة المادة 39 من قانون الأحداث.

" The Court comes to a decision in chambers after having heard the child, witnesses, parents, guardian or person having custody as well as the government procurator and the defence counsel appointed.
" تبت المحكمة في القضية بعد الاستماع إلى الطفل والشهود والوالدين أو الولي أو الوصي القانوني وكذلك إلى وكيل النيابة والمحامي المعين.

The juvenile police may take one of these measures without a court order, if the parents, guardian or tutor give their consent. "
ويجوز لشرطة الأحداث اتخاذ أحد هذه التدابير دون حكم من المحكمة إذا وافق عليه أحد الوالدين أو الولي أو الوصي " .

1. If the guardian is not the father, the cadi may place the girl or boy with whichever of the mother, the guardian or his proxy is the most suitable until such time as the girl marries and the boy reaches adulthood.
1 - إذا كان الولي غير الأب فللقاضي وضع الولد ذكراً أو أنثى عند الأصلح من الأم أو الولي أو من يقوم مقامهما حتى تتزوج البنت أو تبلغ أو يبلغ الصبي سن الرشد.

66. In order to protect children, an enhanced penalty is also imposed if the offender is the victim's spouse or an ascendant, descendant, guardian or trustee, or if the offence is transnational in nature.
66- وتحقيقاً لحماية الأطفال فقد شدد العقوبة أيضاً إذا كان مرتكب الجريمة زوجاً للمجني عليه أو أحد الأصول أو الفروع أو الولي أو الوصي، أو إذا كانت الجريمة ذات طابع (عبر وطني).

55. Article 147 stipulates: " If the legal guardian is not the father, the judge may place the child, whether male or female, in the custody of the mother, the legal guardian or their equivalent, as he deems most appropriate, until the child, if a girl, marries or comes of age or, if a boy, reaches the age of maturity " .
٥٥- كما نصت المادة ٧٤١ على أنه " إذا كان الولي غير اﻷب، فللقاضي وضع الولد ذكراً أو أنثى عند اﻷصلح من اﻷم أو الولي أو من يقوم مقامهما حتى تتزوج البنت أو تبلغ البنت أو يبلغ الصبي سن الرشد " .

If the guardian is a person other than the father, it is left to the judge's discretion to determine whether it would be more appropriate to grant custody to the mother, the guardian or a person fulfilling their role (art. 147 of the Personal Status Act).
وإذا كان الولي غير اﻷب، فيعود للقضاي تقدير اﻷصلح في الرعاية اﻷم أو الولي أو من يقوم مقامهما )م ٧٤١ قانون اﻷحوال الشخصية(.

31. Under article 14 of the Code, in the event that public proceedings are brought against a person under 18 years of age, the court is required to order the person's guardian, legal guardian or carer to attend all proceedings with him or her in order to assist his or her defence. Where necessary, it may appoint a legal guardian for the child in the proceedings.
31- ألزمت المادة 14 من القانون المحكمة في حال رفع الدعوى العمومية على من لم يبلغ الثامنة عشرة من عمره بأن تأمر الولي أو الوصي أو من يقوم برعايته بالحضور معه في جميع الإجراءات ليساعده في الدفاع عن نفسه ولها عند الضرورة أن تعين له وصياً بالخصومة.
