199. In case No. 1910/2009 (Zhuk v. Belarus), the author claimed that her son had been subjected to physical and psychological pressure with the purpose of eliciting a confession of guilt and that his confession served as a basis for his conviction.
199- وفي القضية 1910/2009 (جوك ضد بيلاروس) ادعت صاحبت البلاغ أن ابنها تعرض لضغط جسدي ونفسي بغرض انتزاع اعتراف بالذنب يستخدم أساساً لإدانته.

3.2 The authors also claim that, in violation of article 7 and article 14, paragraph 3 (g), of the Covenant, Mr. Kovalev was subjected to physical and psychological pressure with the purpose to secure a confession of guilt.
3-2 وتزعم صاحبتا البلاغ أيضاً أن السيد كوفاليف قد خضع، انتهاكاً للمادة 7 وللفقرة 3(ز) من المادة 14 من العهد، لضغط جسدي ونفسي بغرض انتزاع اعتراف بالذنب منه.

The Committee recalls its general comment No. 32 on article 14 in which it insists that the right not to testify against oneself must be understood in terms of the absence of any direct or indirect physical or undue psychological pressure from the investigating authorities on the accused, with a view to obtaining a confession of guilt.
وتذكّر اللجنة بتعليقها العام رقم 32 بشأن المادة 14، الذي تؤكد فيه أن الحق في عدم شهادة الشخص على نفسه يجب أن يُفهم على أنه يعني عدم تعريض المتهم لأي ضغوط جسدية مباشرة أو غير مباشرة أو ضغوط نفسية غير مبررة من قبل سلطات التحقيق بغية انتزاع اعتراف بالذنب.

It further recalls that the safeguard set out in article 14, paragraph 3 (g), of the Covenant must be understood in terms of the absence of any direct or indirect physical or undue psychological pressure from the investigating authorities on the accused, with a view to obtaining a confession of guilt.
وتشير كذلك إلى أن الضمانات المنصوص عليها في الفقرة 3(ز) من المادة 14 من العهد، يجب فهمها على أنها تعني عدم ممارسة سلطات التحقيق لأي ضغوط بدنية مباشرة أو غير مباشرة، أو ضغط نفسي غير مبرر، على المتهم، بهدف انتزاع اعتراف بالذنب().

It further recalls that the safeguard laid down in article 14, paragraph 3 (g), of the Covenant must be understood in terms of the absence of any direct or indirect physical or undue psychological pressure from the investigating authorities on the accused, with a view to obtaining a confession of guilt.
وتشير كذلك إلى أن الضمان المنصوص عليه في الفقرة 3(ز) من المادة 14 من العهد يجب فهمه من حيث عدم وجود أي ضغط جسدي أو نفسي غير مباشر لا لزوم له من جانب سلطات التحقيق يُفرض على الشخص المتهم بغرض انتزاع اعتراف بالذنب().

(g) Accused persons have a right not to be compelled to testify against themselves or to confess guilt, in the absence or not of any direct or indirect physical or undue psychological pressure from the investigating authorities on the accused, with a view to obtaining a confession of guilt.
(ز) حق المتهمين في عدم إكراههم على الشهادة ضد أنفسهم أو على الاعتراف بالذنب سواء بعد تعرضهم أو بدون تعرضهم لضغوط جسدية مباشرة أو غير مباشرة أو نفسية غير مبررة من جانب سلطات التحقيق بغية انتزاع اعتراف بالذنب.

It recalls its jurisprudence that the wording, in article 14, paragraph 3 (g), that no one shall " be compelled to testify against himself or confess guilt " , must be understood in terms of the absence of any direct or indirect physical or psychological coercion by the investigating authorities of the accused with a view to obtaining a confession of guilt.
وتشير إلى أحكامها السابقة التي مفادها أن الصياغة الواردة في الفقرة 3(ز) من المادة 14 بأنه لا يجوز [إكراه أحد] " على الشهادة ضد نفسه أو على الاعتراف بذنب " ، يجب أن تُفهم على أنها تستبعد استخدام أي شكل مباشر أو غير مباشر من الإكراه الجسدي أو النفسي من جانب السلطات المسؤولة عن التحقيق بغية انتزاع اعتراف بالذنب من المُتهم().

11.2 The Committee notes the authors' claims under articles 7 and 14, paragraph 3 (g), of the Covenant that Mr. Kovalev was subjected to physical and psychological pressure with the purpose of eliciting a confession of guilt and that, although he retracted his self-incriminating statements during court proceedings, his confession served as a basis for his conviction.
11-2 وتحيط اللجنة علماً بادعاءات صاحبتي البلاغ بموجب المادة 7 والفقرة 3(ز) من المادة 14 من العهد وأن السيد كوفاليف قد تعرض لضغط جسدي ونفسي بغرض انتزاع اعتراف بالذنب منه وبأنه وإن تراجع عن تصريحاته التي أدان فيها نفسه أثناء الإجراءات في المحكمة، إلاّ أنّ اعترافه استُخدم كأساس لإدانته.
