For instance, there is a clear distinction between circumstances where a State loses control of part of its territory, to insurgents for example, and circumstances where the State is unable to compel persons within the territory which is under its control to conduct themselves as they ought – perhaps because key workers are on strike.

74. From the firmly established principles of international law mentioned above, it is clear that a State affected by a disaster has the freedom to adopt whatever measures it sees fit to ensure the protection of the persons found within its territory.
74 - ويتضح من مبادئ القانون الدولي الراسخة المذكورة أعلاه أن للدولة التي ألمّت بها كارثة حرية اتخاذ أي تدابير تراها مناسبة لكفالة حماية الأشخاص الموجودين داخل إقليمها.

In resolution 49/165, the General Assembly recognized the obligations of sending countries to protect and promote interests of their citizens and the obligations of receiving countries to ensure the human rights of all persons within their boundaries, and specifically those of women migrant workers.
٢ - وفي قرار الجمعية العامة ٤٩/١٦٥، سلمت الجمعية بالتزامات البلدان المرسلة بحماية ورعاية مصالح مواطنيها، وبالتزامات البلدان المستقبلة بتأمين حقوق اﻹنسان لجميع اﻷشخاص الموجودين داخل حدودها، وبخاصة حقوق العاملات المهاجرات.

While acknowledging that it was the primary duty of a State to provide employment and appropriate training and education to its citizens to enable them to improve their lot in life, receiving countries also had a moral obligation, as signatories to the Charter of the United Nations, to ensure that the fundamental human rights and freedom of all persons within their boundaries were protected.
ومع الاعتراف بأن الواجب اﻷساسي ﻷية دولة هو توفير العمل والتدريب والتعليم الملائمين لمواطنيها لتمكينهم من تحسين نصيبهم من الحياة، فإنه يترتب على البلدان المستقبلة أيضا التزام معنوي، بوصفها موقعة على ميثاق اﻷمم المتحدة، بضمان حماية الحقوق المدنية اﻷساسية لجميع اﻷشخاص الموجودين داخل حدودها وحرية هؤلاء اﻷشخاص.

In formulating his proposal for draft article 9, the Special Rapporteur took particular note of the principles of State sovereignty and non-intervention, concluding that " it is clear that a State affected by a disaster has the freedom to adopt whatever measures it sees fit to ensure the protection of the persons found within its territory " (ibid., para. 74).
وأورد المقرّر الخاص، عند صياغة مشروع المادة 9 المقترح، إشارة خاصة إلى مبدأَي سيادة الدول وعدم التدخل، وخلُص إلى أنه يتضح " أن للدولة التي ألمّت بها كارثة حريةَ اتخاذ أي تدابير تراها مناسبة لكفالة حماية الأشخاص الموجودين داخل إقليمها " (المرجع نفسه، الفقرة 74).

63. The Commission having established that the individual, as a bearer of rights and as a person with essential needs, stands at the centre of its work on the topic (see draft article 2), the Special Rapporteur will now consider the role and responsibility of the affected State towards the persons found within its territory.
63 - بعد أن أثبتت اللجنة أن الفرد، بوصفه حاملاً لحقوق وشخصاً له احتياجات أساسية، يتبوأ موقعا مركزيا فيما تضطلع به من عمل في الموضوع (انظر مشروع المادة 2)، سينظر المقرر الخاص الآن في دور الدولة المتضررة ومسؤوليتها إزاء الأشخاص الموجودين داخل إقليمها.
