وتؤكد الدولة الطرف أن الشهادة المذكورة أعلاه لا تقدّم أسباباً وجيهة تدعم ادعاءات صاحب الشكوى بأنه سيتعرض للتعذيب وسوء المعاملة لدى عودته إلى الصين.

He recalls that the State party has not contested his political activities and that, contrary to the State party's claims, he does not maintain that he is simply afraid of being arrested on his return, but has serious grounds for believing that he would be tortured.
ويذكّر بأن الدولة الطرف لم تنكر أنشطته السياسية وأنه، على عكس ما تدعيه الدولة الطرف، لا يزعم أنه يخشى فقط الاعتقال لدى عودته، وإنما وجود أسباب حقيقية تحمل على الاعتقاد بأنه سيتعرض للتعذيب.

4.4 The State party further states that it refrains from making an evaluation of its own regarding whether or not the author has substantiated his claim that he would risk being tortured if expelled, and leaves it to the discretion of the Committee to determine whether the case reveals a violation of article 3 of the Convention.
4-4 وتذكر الدولة الطرف أيضاً أنها تمسك عن إصدار حكم بنفسها فيما يتعلق بما إذا كان صاحب البلاغ قد أيد ادعاءه بأنه سيتعرض للتعذيب في حالة ترحيله وأنها تترك هذه المسألة لتقدير اللجنة للبت فيما إذا كانت الحالة تكشف عن انتهاك للمادة 3 من الاتفاقية.

3.1 The complainant contends that there are substantial grounds for believing that he will be subjected to torture if returned to Somalia, placing the State party in breach of its obligations under article 3 of the Convention.
3-1 يرى مقدم الشكوى أنه توجد أسباب قوية تدعو للاعتقاد بأنه سيتعرض للتعذيب إذا أعيد إلى الصومال، وبهذا تكون الدولة الطرف منتهكة لالتزاماتها بموجب المادة 3 من الاتفاقية.

As for the merits, he has failed to demonstrate that there are sufficient grounds for believing that he would be subjected to torture if returned to the Democratic Republic of the Congo for the reasons listed below.
وفيما يتعلق بالأسس الموضوعية،لم يقدم صاحب الشكوى أدلة كافية تدعو إلى الاعتقاد بأنه سيتعرض للتعذيب في حالة عودته إلى جمهورية الكونغو الديمقراطية، وذلك للأسباب أدناه.

Country information received by the State party indicates that, even if the Algerian authorities were aware of the petitioner's applications, there is no substantial reason for believing that he would be subjected to torture.
وتشير المعلومات القطرية الواردة إلى الدولة الطرف إلى أنه حتى إذا كانت السلطات الجزائرية على علم بالطلبات التي قدمها صاحب البلاغ، فإنه لا يوجد سبب وجيه للاعتقاد بأنه سيتعرض للتعذيب.

3. The complainant claims that if returned to Bangladesh, there are substantial grounds to believe that he would be subjected to torture.

4.4 The author claims that there is a real risk that he would be subjected to torture or that his security would be endangered if he were to be returned to his country.
٤-٤ ومقدم البلاغ يدعــي أن هنــاك خطرا حقيقيا بأنه سيتعرض للتعذيب أو بأن أمنه سيتهدد إذا ما أعيد إلى بلده.

3.1 The complainant claims that there are substantial grounds for believing that he would be subjected to torture if he were forced to return to Bangladesh, a violation of article 3 by Sweden of the Convention.
3-1 يدّعي صاحب الشكوى أن هناك أسباباً وجيهة تبرر الاعتقاد بأنه سيتعرض للتعذيب إذا ما أُجبر على العودة إلى بنغلاديش، مما يشكل انتهاكاً من قِبَل السويد لأحكام المادة 3 من الاتفاقية.

3.1 The complainant asserts that there are substantial grounds for believing that he would be subjected to torture if he was returned to Bangladesh and that his expulsion to that country would constitute a violation by Switzerland of article 3 of the Convention.
3-1 يؤكد صاحب الشكوى وجود أسباب حقيقية تحمل على الاعتقاد بأنه سيتعرض للتعذيب إذا أُعيد إلى بنغلاديش، وأن طرده إلى ذلك البلد يشكل انتهاكاً من جانب سويسرا لأحكام المادة 3 من الاتفاقية.

The complainant claimed that his forcible removal to Iraq would constitute a violation by Canada of article 3 of the Convention, as there were substantial grounds for believing that he would be tortured and even killed in present-day Iraq for having been a member of Saddam Hussein's Republican Guards and because he was a Sunni Muslim.
فقد ادّعي صاحب البلاغ أن ترحيله القسري إلى العراق سيشكل انتهاكاً من جانب كندا للمادة 3 من الاتفاقية، لوجود أسباب جوهرية تحمل على الاعتقاد بأنه سيتعرض للتعذيب بل للقتل في ظل الظروف السائدة في العراق حالياً لأنه كان عضواً في الحرس الجمهوري لصدام حسين ولأنه مسلم سني.

In relation to the complainant, it notes first that his support for the banned political organization Fedayeen is not itself sufficient reason to assume that he would be tortured upon return; thus, recent country reports record no recent cases of convictions of Fedayeen members.

6.5 In the present case, the Committee observes that the complainant's allegations that he would risk being tortured if returned to Sudan rely on the fact that members of JEM face a high risk of detention and torture and on the general human rights records of Sudan.
6-5 وفي هذه القضية، تلاحظ اللجنة أن ادعاءات صاحب الشكوى بأنه سيتعرض للتعذيب إذا ما أعيد إلى السودان تستند إلى كون الأعضاء المنتمين إلى حركة العدالة والمساواة يتعرضون لخطر الاحتجاز والتعذيب بصورة كبيرة وإلى سجلات السودان في مجال حقوق الإنسان عموماً.

10. In particular, the Committee wished to receive from the author’s counsel more precise and detailed information concerning the character and frequency of the author’s publications, the nature of his political activities as well as his reasons to believe that he will be subjected to torture upon his return to Djibouti.
١٠ - وترغب اللجنة بصفة خاصة أن تتلقى من محامي صاحب البلاغ معلومات أكثر دقة وتفصيلا عن طبيعة منشورات صاحب البلاغ وتواترها، وطبيعة أنشطته السياسية، ودواعي اعتقاده بأنه سيتعرض للتعذيب إذا عاد إلى جيبوتي.

The author therefore failed to establish a real risk that he would be subject to torture or cruel, inhuman or degrading treatment if returned to China.
ولذلك فإن صاحب البلاغ لم يثبت وجود خطر فعلي بأنه سيتعرض للتعذيب أو غيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة في حال عودته إلى الصين.
