The State party submits that the facts do not disclose any violation of the author's rights under article 14, paragraph 5, of the Covenant.
وتدفع الدولة الطرف بأن الوقائع لا تكشف عن أي انتهاك لحقوق صاحب البلاغ بموجب الفقرة 5 من المادة 14 من العهد.

5.7 In light of the above, the complainants submit that the facts presented by the main complainant have been coherent, plausible and consistent.

While I agree with the majority's conclusion in paragraph 9 that the facts before the Committee reveal a violation of article 18, paragraph 1, I disagree with the reasoning of the majority, as will be apparent from the following observations:
رغم اتفاقي مع استنتاج الأغلبية في الفقرة 9 بأن الوقائع المعروضة على اللجنة تكشف انتهاكاً للفقرة 1 من المادة 18، فإنني أختلف مع استدلال الأغلبية، كما سيتجلّى من الملاحظات التالية:

3.1 Counsel contends that the facts as described above constitute a violation of articles 25, subparagraph (c) and 26 of the Covenant.
٣-١ يدعي المحامي بأن الوقائع كما هي مبينه أعلاه تشكل انتهاكا للمادة ٢٥، الفقرة الفرعية )ج( والمادة ٢٦ من العهد.

3.2 The author claims that the facts constitute a violation of article 3 of the Covenant, in conjunction with articles 17 and 26.
3-2 وتدعي صاحبة البلاغ بأن الوقائع تشكل انتهاكاً للمادة 3 من العهد، إلى جانب المادتين 17 و26.

5.4 The complainant further argues that the facts do not support the State party's observation that he was not " singled out " .
5-5 ويجال صاحب الشكوى كذلك بأن الوقائع لا تؤيد ما ذكرته الدولة الطرف من أنها لم " تخصه " دون غيره بالإعادة إلى بلده.

In so far as that holding suggests that there is a deficiency in the law, I do not think there is; in so far as it suggests that the facts are not sufficient to attract an application of the law, I am not able to agree.
فبقدر ما يوحي هذا الحكم بأن هناك عيبا في القانون، لا أعتقد بأن ثمة عيبا؛ وبقدر ما يوحي بأن الوقائع غير كافية لاجتذاب تطبيق القانون، لا أستطيع الموافقة على ذلك.

Moreover, the Supreme Court had not taken into consideration the prosecutor's contention that the facts could not be legally characterized in that way, since they referred to the truncated execution of the offence of drug trafficking.

7.5 The State party also argues that the facts that are the subject of the communication occurred prior to the entry into force of the Optional Protocol for Spain on 6 October 2001, as well as prior to the entry into force of the Convention itself.
