وقد أدى إنشاء هذا الفريق، باﻹضافة الى تطورات أخرى، الى إنشاء الولاية المتعلقة بحالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي.

1. The present report is the first report to be submitted to the General Assembly since the mandate on summary and arbitrary executions was established by the Economic and Social Council in its resolution 1982/35 of 7 May 1982.
١ - هذا التقرير هو أول تقرير يقدم الى الجمعية العامة منذ أن أنشأ المجلس الاقتصادي والاجتماعي الولاية بشأن حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي في قراره ١٩٨٢/٣٥ المؤرخ ٧ أيار/مايو ١٩٨٢.

The first communication, dated 17 October 1995 following an urgent appeal transmitted by the Special Rapporteur on extrajudicial, summary and arbitrary executions, raised the concern of the Special Rapporteur over the allegation that Balabagan's original sentence of seven years' imprisonment had been overturned and replaced by the death penalty.
وعبرت المقررة الخاصة في رسالتها اﻷولى المؤرخة في ٧١ تشرين اﻷول/أكتوبر ٥٩٩١، التي أتت في إثر نداء مستعجل من المقرر الخاص المعني بحالات اﻹعدام بلا محاكمة أو بإجراءات موجزة واﻹعدام التعسفي عن قلقها إزاء الادعاءات القائلة بأن الحكم اﻷصلي الصادر بسجن بالاباغان سبع سنوات قد نقض واستبدل باﻹعدام.

89. While the Special Rapporteur has received reports and specific allegations of shelling and bombardments of civilian settlements, the most consistent violation of the right to life is said to stem from the continuing summary and arbitrary executions within the border areas, resulting in the death of large numbers of innocent persons, including women, children and elderly persons.
٨٩ - وبينما تلقى المقرر الخاص تقارير وادعاءات محددة عن قصف المستوطنات المدنية بالمدفعية والقنابل، يقال إن أكثر الانتهاكات لحق الحياة حدوثا بانتظام ينشأ عن استمرار حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي داخل المناطق الحدودية، مما يترتب عليه موت أعداد كبيرة من اﻷبرياء، ومنهم نساء وأطفال ومسنون.

(ii) The occurrences of cases of summary and arbitrary execution, disappearance, torture, arbitrary arrest and detention without trial of, among others, journalists, opposition politicians, human rights defenders and people who have cooperated with the United Nations mechanisms;
' 2` حالات الإعدام بإجراءات موجزة والإعدام التعسفي والاختفاء والتعذيب والاحتجاز تعسفا وبدون محاكمة التي يتعرض لها، ضمن أشخاص آخرين، الصحفيون والسياسيون المعارضون والمدافعون عن حقوق الإنسان والأفراد المتعاونون مع آليات الأمم المتحدة؛

19. Invites the Special Rapporteur to submit an interim report to the General Assembly at its fifty-first session on the situation worldwide in regard to summary or arbitrary executions and his recommendations for more effective action to combat that phenomenon;
٩١- تدعو المقرر الخاص إلى تقديم تقرير مؤقت إلى الجمعية العامة في دورتها الحادية والخمسين عن حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي في جميع أرجاء العالم مشفوعاً بتوصياته لزيادة فعالية إجراءات مكافحة هذه الظاهرة؛

10. Urges the Special Rapporteur to continue to draw to the attention of the United Nations High Commissioner for Human Rights such situations of extrajudicial, summary and arbitrary executions as are of particularly serious concern to him or where early action might prevent further deterioration;
١٠ - تحث المقرر الخاص على مواصلة توجيه انتباه مفوض اﻷمم المتحدة السامي لحقوق الانسان إلى حالات اﻹعدام خارج نطاق القانون واﻹعدام بإجراءات موجزة واﻹعدام التعسفي التي تثير قلقا خاصا شديدا لديه أو التى يمكن أن يحول اتخاذ اجراء مبكر بصددها دون مزيد من التردي؛

10. Urges the Special Rapporteur to continue to draw to the attention of the United Nations High Commissioner for Human Rights such situations of extrajudicial, summary and arbitrary executions as are of particularly serious concern to him or where early action might prevent further deterioration;
١٠ - تحث المقرر الخاص على مواصلة توجيه انتباه مفوض اﻷمم المتحدة السامي لحقوق الانسان الى حالات اﻹعدام خارج نطاق القانون واﻹعدام بإجراءات موجزة واﻹعدام التعسفي التي تثير قلقا خاصا شديدا لديه أو حيث يمكن أن يحول اتخاذ اجراء مبكر بصددها دون مزيد من التردي؛

133. In resolution 1994/87, the Commission deplored " the continuing ... enforced disappearances, summary and arbitrary executions of persons who have exercised their right to freedom of opinion and expression ... " in Zaire.
٣٣١- وقد شجبت لجنة حقوق الانسان، في قرارها رقم ٤٩٩١/٧٨، " استمرار ... حالات الاختفاء القسري، واﻹعدام بإجراءات موجزة واﻹعدام التعسفي ضد أشخاص مارسوا حقهم في حرية الرأي والتعبير ... " في زائير.

(d) The occurrence of cases of summary and arbitrary execution, disappearance, torture, beating, harassment and arrest, the persecution of individuals and the arbitrary detention for long periods of persons, including journalists, opposition politicians, human rights defenders, people who have cooperated with the United Nations mechanisms and other members of civil society;
(د) حالات الإعدام بإجراءات موجزة والإعدام التعسفي والاختفاء والتعذيب والجلد والملاحقة والاعتقال والاضطهاد التي ترتكب في حق الأفراد والاحتجاز التعسفي لفترات طويلة لآخرين، يشملون الصحفيين والسياسيين المعارضين والمدافعين عن حقوق الإنسان والمتعاونين مع آليات الأمم المتحدة وغيرهم من أفراد المجتمع المدني؛

At its fifty-second session, in 1996, the Commission on Human Rights invited the Special Rapporteur on extrajudicial, summary or arbitrary executions to submit an interim report to the General Assembly at its fifty-first session on the situation worldwide in regard to summary or arbitrary executions and his recommendations for more effective action to combat that phenomenon (Commission resolution 1996/74).
دعت لجنة حقوق اﻹنسان في دورتها الثانية والخمسين المعقودة عام ١٩٩٦، المقرر الخاص بشأن حالات اﻹعدام خارج نطاق القانون، أو بإجراءات موجزة أو اﻹعدام التعسفي إلى تقديم تقرير مؤقت إلى الجمعية العامة في دورتها الحادية والخمسين عن حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي في جميع أرجاء العالم مشفوعا بتوصياته لزيادة فعالية إجراءات مكافحة هذه الظاهرة )قرار اللجنة ١٩٩٦/٧٤(.

The Special Rapporteur has examined the issue from various aspects with a view to presenting a comprehensive picture of the phenomenon of summary or arbitrary executions in the contemporary world.
ودرس المقرر الخاص المسألة من جوانب شتى بغية عرض صورة شاملة لظاهرة حالات اﻹعدام بإجراءات موجزة واﻹعدام التعسفي في العالم المعاصر.
