That Working Group recommended the development of comprehensive software-based information-gathering tools for the Organized Crime Convention and each of its Protocols.

E. Implementation of the Protocols to the Organized Crime Convention

A project on combating trafficking in persons in Central Asia is aimed at facilitating the efforts of CIS member States to meet the requirements of the Protocols to the Organized Crime Convention.
ويهدف مشروع بشأن مكافحة الاتجار بالأشخاص في آسيا الوسطى إلى تسهيل جهود الدول الأعضاء في كومنولث الدول المستقلة للوفاء بمتطلبات البروتوكولين الملحقين باتفاقية الجريمة المنظمة.

12. Pursuant to the Organized Crime Convention and the Convention against Corruption, many Member States have put in place the legal basis for the provision of mutual legal assistance.

Another country referred to the different terminology and legal concepts employed in its national legislation in comparison to the Organized Crime Convention.
56- وأشار بلد آخر إلى اختلاف المصطلحات والمفاهيم القانونية المستخدمة في تشريعاته الوطنية مقارنة باتفاقية الجريمة المنظمة.

In that context, Canada underscored that the vast majority of major transnational fraud cases involved organized criminal groups and that the focus of further work should be on finding ways to use the Organized Crime Convention more effectively instead of developing any further instruments.
وفي هذا السياق، شددت كندا على أن الغالبية العظمى من قضايا الاحتيال الكبرى عبر الوطنية تتورط فيها جماعات إجرامية منظمة، وأنه ينبغي أن تنصبّ الأعمال الإضافية في هذا الصدد على إيجاد السبل الكفيلة بالاستعانة باتفاقية الجريمة المنظمة بفعالية أكبر بدلاً من وضع المزيد من الصكوك.

Based on those observations, the High-level Panel made the following recommendations in relation to the Organized Crime Convention and its Protocols:
52- واستنادا إلى تلك الملاحظات، قدم الفريق الرفيع المستوى التوصيات التالية فيما يتعلق باتفاقية الجريمة المنظمة وبروتوكولاتها:

9. Encourages Member States to adopt relevant measures, including, if necessary, reviewing relevant legislation, including criminal legislation, and to criminalize the acts covered by the Organized Crime Convention and the Smuggling of Migrants Protocol, including by introducing appropriate sanctions commensurate with the nature and gravity of the offence;
9 - يشجع الدول الأعضاء على اعتماد تدابير مناسبة، بما يشمل، عند الاقتضاء، استعراض التشريعات ذات الصلة، بما فيها التشريعات الجنائية، وتجريم الأفعال المشمولة باتفاقية الجريمة المنظمة وبروتوكول تهريب المهاجرين، وذلك بعدة وسائل منها فرض عقوبات ملائمة تتناسب وطبيعة الجرائم المرتكبة وخطورتها؛

60. In comparison with the Organized Crime Convention and the Convention against Corruption, the FATF Forty Recommendations provide a stricter definition of financial institutions and designated non-financial businesses and professions: the term " financial institutions " is defined broadly, through a functional rather than a legalistic approach.
60- وتوفر توصيات فرقة العمل، مقارنة باتفاقية الجريمة المنظمة واتفاقية مكافحة الفساد، تعريفا أكثر تشددا للمؤسسات المالية والمنشآت والمهن غير المالية المحددة: فعبارة " المؤسسات المالية " معرّفة تعريفا واسعا، باتباع نهج وظيفي بدلا من نهج ذي صبغة قانونية.

19. With regard to the Organized Crime Convention and its two Protocols already in force (the Trafficking in Persons Protocol and the Migrants Protocol), the Government of Algeria declared that its ratification of the instruments did not signify recognition of Israel nor did it entail the establishment of relations of any kind with Israel.
19- فيما يتعلق باتفاقية الجريمة المنظمة وبروتوكوليها النافذي المفعول حاليا (بروتوكول الاتجار بالأشخاص وبروتوكول المهاجرين)، أعلنت حكومة الجزائر بأن تصديقها على الصكوك لا يدلّ على الاعتراف بإسرائيل ولا يستتبع إقامة علاقات من أي نوع كان مع اسرائيل.

In such cases, treaty-based countries have the options of applying paragraph 1 of article 16 in lieu of their bilateral treaty or of applying paragraph 3 of article 16, which requires the States parties to deem the offences covered by the Convention as included in their bilateral extradition treaties and so to expand the scope of those treaties to the offences covered by the Organized Crime Convention.
وفي هذه الحالات، يكون أمام البلدان التي تستند إلى المعاهدات خيار تطبيق الفقرة 1 من المادة 16 بدلا من معاهداتها الثنائية، أو تطبيق الفقرة 3 من المادة 16 التي تقضي بأن تعتبر الدول الأطراف الجرائم المشمولة في الاتفاقية مدرجة في معاهداتها الثنائية الخاصة بتسليم المطلوبين، وأن تقوم بالتالي بتوسيع نطاق تلك المعاهدات ليشمل الجرائم المشمولة باتفاقية الجريمة المنظمة.

In addition, the Conference welcomed a number of tools developed by UNODC, including the mutual legal assistance request writer tool, and endorsed the proposal for the development of an online directory of central authorities dealing with requests of various kinds pursuant to the Organized Crime Convention and the Protocols thereto.

With regard to the application of the relevant provisions of the Organized Crime Convention on extradition and mutual legal assistance in cases covered by the Firearms Protocol, reference should be also made to the analytical report on the implementation of the Organized Crime Convention, which has been updated to provide information based on additional responses received from States for the first reporting cycle (CTOC/COP/2005/2/Rev.1).
