Under this law, the Council of Ministers is authorized to pass an order, as may be necessary, restricting any fundamental right of a person if there are reasons to believe that any citizen has committed or is committing or is about to commit any act which infringes the sovereignty and security of the State or public peace and tranquillity.
وبموجب هذا القانون، يجوز لمجلس الوزراء " إصدار أي أمر، حسب الاقتضاء، لتقييد أي حق أساسي ﻷي شخص إذا وجدت أسباب تدعو الى الاعتقاد بأن أي مواطن قد ارتكب أو يقوم بارتكاب أو على وشك أن يرتكب أي عمل يخل بسيادة الدولة وأمنها أو السلام والهدوء العامين.

11. Stresses that States must not punish personnel who are involved in the custody, interrogation or treatment of any individual subjected to any form of arrest, detention or imprisonment or any other form of deprivation of liberty for not obeying orders to commit or conceal acts amounting to torture or other cruel, inhuman or degrading treatment or punishment;
11 - تؤكـد أنه يجب على الدول ألا تعاقـب الموظفين الذين تكون لهم علاقة بحبس أو استجواب أو معاملة أي فـرد يتعرض لأي شكل من أشكال الاعتقال أو الاحتجاز أو السجن، أو أي شكل آخر من أشكال الحرمان من الحرية، لعدم امتثالهم لأوامر بارتكاب أو إخفـاء أفعال تعـد تعذيبا أو غيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة؛

(b) The weaknesses related to the indictments themselves, namely, the fact that most defendants were not accused of committing or commanding the commission of crimes against humanity, but rather of being accomplices to the commission of crimes committed by others or on a theory of command responsibility which does not correspond to international standards.
(ب) مواطن الضعف في لوائح الاتهام نفسها، وهي كون معظم المدعى عليهم غير متهمين بارتكاب أو قيادة ارتكاب ضد البشرية، بل اتُهموا بدلاً من ذلك بالتواطؤ في جرائم ارتكبها أو دبرها أشخاص آخرون، أو على أساس نظرية المسؤولية القيادية التي لا تتماشى والمعايير الدولية.
