As I reported last year, 191 States are parties to the Statute of the Court, and 66 of them have accepted the compulsory jurisdiction of the Court in accordance with Article 36, paragraph 2, of its Statute.

In addition to the lack of diplomatic relations between the countries, Kuwait stated that “there is no legal forum in which Kuwait could take proceedings against Iraq, because Iraq has filed no declaration recognizing the compulsory jurisdiction of the International Court of Justice at The Hague [as it is required to do] under article 36 of that court’s statute”.

This approach was later endorsed by the Court itself in the Border and Transborder Armed Actions (Nicaragua v. Honduras) case, in which Honduras sought to have its reservation to its declaration of acceptance of the compulsory jurisdiction of the Court under the optional clause take precedence over its obligations by virtue of article XXXI of the Pact of Bogotá.
وأيدت المحكمة نفسها هذا النهج لاحقاً في القضية المتعلقة بالأعمال المسلحة على الحدود وعبر الحدود (نيكاراغوا ضد هندوراس) التي كانت فيها هندوراس تعتزم تغليب تحفظها على الإعلان الاختياري المتعلق بالاختصاص الإلزامي للمحكمة على التزاماتها بموجب المادة الحادية والثلاثين من ميثاق بوغوتا.

It therefore welcomed the approval of General Assembly resolution 57/26 of 19 November 2002, on the prevention and peaceful settlement of disputes, which in paragraph 9 reminded States of the need to declare that they recognized the compulsory jurisdiction of the International Court of Justice.
لذلك ترحب بموافقة الجمعية العامة على القرار (26/57) المؤرخ 19 تشرين الثاني/نوفمبر 2002، الخاص بالتسوية السلمية ومنع المنازعات الذي تذكر الدول في الفقرة 9 منه إلى ضرورة إعلان أنها تعترف بالاختصاص الإلزامي لمحكمة العدل الدولية.

Initiatives by the Office of Legal Affairs to strengthen the role of the Court included encouraging States to make declarations recognizing the Court's compulsory jurisdiction at the 2010 and 2011 annual treaty events and a seminar on the Court's contentious jurisdiction which brought legal advisers of foreign ministries together with the President and other members of the Court in New York.

12. His country sought to contribute to the rule of law by becoming a party to the main multilateral legal instruments; it was, for instance, one of the 67 States Members of the United Nations (out of 192) that had had the courage to recognize the compulsory jurisdiction of the International Court of Justice pursuant to article 36, paragraph 2, of its Statute.
12- وقال إن بلده سعى إلى المساهمة في سيادة القانون بأن أصبح طرفاً في الصكوك الدولية الرئيسية المتعددة الأطراف؛ فقد كانت دولته، مثلاً، واحدةً من الدول الـ 67 (من مجموع 192 دولة) التي وجدت لديها الشجاعة للاعتراف بالاختصاص الإلزامي لمحكمة العدل الدولية، وفقاً للفقرة 2 من المادة 36 من النظام الأساسي للمحكمة.

5. Since the establishment of IHFFC in 1991, it has not received any fact-finding mandate because there has not been any armed conflict where indeed all parties to it had recognized the obligatory competence of the Commission or where all parties have requested IHFFC to act.
