8.10 The Committee recalls that it is generally up to the courts of States parties to evaluate the facts and evidence in a particular case, and that it is not up to the Committee to review the evaluation, unless it can be ascertained that the court's evaluation was clearly arbitrary or amounted to denial of justice, or that the court had violated its obligation of independence and impartiality.
8-10 وتذكّر اللجنة بأن تقييم الوقائع والأدلة في قضية معيّنة يعود إلى محاكم الدول الأطراف عموماً، وليس من مسؤولية اللجنة مراجعة التقييم إلاّ إذا أمكن التيقّن من أن تقييم المحكمة كان على نحو واضح تعسفياً أو بلغ حد الحرمان من العدالة، أو أن المحكمة أخلّت بواجبها بالاستقلال والنزاهة().
