ويجري سماع شهود النفي في الجلسة ذاتها التي سمع فيها شهود الإثبات، إلاّ إذا حال دون ذلك مانع، وإذا أجل التحقيق لجلسة أخرى كان النطق بالتأجيل بمثابة تكليف لمن يكون حاضراً من الشهود بالحضور في تلك الجلسة إلا إذا أعفتهم المحكمة صراحةً من الحضور.
