12. To expedite consideration of the proposed United Nations principles on the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms;
12- النظر بصورة عاجلة في مبادئ الأمم المتحدة المقترحة المتعلقة بالحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الإنسان والحريات الأساسية.

(iv) The Special Rapporteur on the right to restitution, compensation and rehabilitation for victims of gross violations of human rights, Mr. Theo van Boven, stated that more systematic attention should be given at both the national and international levels to the implementation of the right to reparation for victims of gross violations of human rights and humanitarian norms.
`٤` ذكر المقرر الخاص المعني بالحق في الاسترداد والتعويض وإعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق اﻹنسان والحريات اﻷساسية السيد ثيو فان بوفن أنه يجب التشديد بمزيد من الانتظام على إعمال حق ضحايا انتهاكات حقوق الانسان الجسيمة والمعايير الانسانية في الجبر، وذلك على الصعيدين الوطني والدولي.

20.3 States shall ensure that all national policies related to the right to restitution fully guarantee women's rights to non-discrimination and to equality in both law and practice.
20-3 تضمن الدول توفير جميع السياسات الوطنية المتعلقة بالحق في الاسترداد لضمانات كاملة لحقوق المرأة في عدم التعرض للتمييز وفي المساواة في القانون والممارسة على السواء.

4. Requests States that have not yet done so to provide information to the Secretary-General on the legislation already adopted, as well as that in the process of being adopted, relating to the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms;
٤- ترجو من الدول التي لم تقم بعد بموافاة اﻷمين العام بمعلومات عن التشريعات التي اعتمدتها فعلاً أو التي هي بصدد اعتمادها فيما يتصل بالحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الانسان والحريات اﻷساسية أن تفعل ذلك؛

The Sub-Commission further requested the expert in the preparation of this study to take into account information, including on " comfort women " , which had been submitted to the Special Rapporteur on the right to restitution, compensation and rehabilitation of victims of gross violations of human rights.
وطلبت اللجنة الفرعية أيضا من الخبيرة أن تضع في اعتبارها عند اعدادها لدراستها تلك المعلومات التي سبق أن أرسلت إلى المقرر الخاص المعني بالحق في الاسترداد والتعويض وإعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق اﻹنسان، بما فيها المعلومات عن " نساء الترفيه " .

6. Following the adoption of the agenda, the working group decided to invite Mr. Theo van Boven, former Special Rapporteur of the Sub-Commission on the right to restitution, compensation and rehabilitation for victims of gross violations of human rights, to participate in the discussion on the agenda item relating to basic principles and guidelines on the right to reparation.
٦- وعقب إقرار جدول اﻷعمال، قرر الفريق العامل دعوة السيد ثيو فان بوفن، المقرر الخاص السابق للجنة الفرعية المعني بالحق في الاسترداد والتعويض وإعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق الانسان، للمشاركة في مناقشة بند جدول اﻷعمال المتعلق بالمبادئ اﻷساسية والخطوط التوجيهية الخاصة بالحق في الجبر.

The Special Rapporteur of the Sub-Commission on the right to restitution, compensation and rehabilitation for victims of gross violations of human rights and fundamental freedoms, Mr. Theo van Boven, noted in his study that forms of reparations included restitution, compensation, and rehabilitation.
٤٧- إن المقرر الخاص للجنة الفرعية المعنية بالحق في الاسترداد والتعويض وإعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق اﻹنسان والحريات اﻷساسية، السيد ثيو فان بوفِن، قد لاحظ في دراسته أن أشكال الجبر تشمل الاسترداد والتعويض وإعادة التأهيل.

6. At the invitation of the working group, Mr. Theo van Boven, former Special Rapporteur of the Sub-Commission on the right to restitution, compensation and rehabilitation for victims of gross violations of human rights, also participated in the discussion on the agenda item relating to basic principles and guarantees concerning the right to restitution and compensation.
٦- وبناء على دعوة الفريق العامل، شارك أيضاً السيد ثيوفان بوفن، المقرر الخاص السابق للجنة الفرعية المعني بالحق في الاسترداد والتعويض وإعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق الانسان، في مناقشة البند المتعلق بالمبادئ والضمانات اﻷساسية الخاصة بالحق في الاسترداد والتعويض من جدول اﻷعمال.

11. In his opening statement, the representative of the Centre for Human Rights, said that at its previous session the working group had taken a further step forward by considering the basic principles and guidelines concerning the right to restitution, compensation and rehabilitation for victims of gross violations of human rights and fundamental freedoms.
١١- وأعلن ممثل مركز حقوق الانسان، في بيانه الافتتاحي، أن الفريق العامل قد اجتاز مرحلة إضافية في دورته اﻷخيرة بدراسته للمبادئ والخطوط التوجيهية اﻷساسية المتعلقة بالحق في الاسترداد والتعويض وإعادة التأهيل لضحايا الانتهاكات الجسيمة لحقوق اﻹنسان والحريات اﻷساسية.

45. In its resolution 1996/35, the Commission requested States that have not yet done so to provide information to the Secretary-General on the legislation already adopted, as well as that in the process of being adopted, relating to the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms.
٥٤- رجت اللجنة، في قرارها ٦٩٩١/٥٣، من الدول التي لم تقم بعد بموافاة اﻷمين العام بمعلومات عن التشريعات التي اعتمدتها فعلاً أو التي هي بصدد اعتمادها فيما يتصل بالحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة والحريات اﻷساسية أن تفعل ذلك.

270. At the 28th meeting, on 5 April 2000, the independent expert on the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms, Mr. Cherif Bassiouni, introduced his report (E/CN.4/2000/62).
270- وفي الجلسة 28 المعقودة في 5 نيسان/أبريل 2000، قام السيد شريف بسيوني، الخبير المستقل المعني بالحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الجسيمة لحقوق الإنسان والحريات الأساسية، بعرض تقريره (E/CN.4/2000/62).

4. In resolution 1997/29 the Commission also expressed its appreciation to States that had provided information on the matter to the Secretary—General and requested those that had not yet done so to provide information on legislation already adopted, as well as that in the process of being adopted, relating to the right to restitution, compensation and rehabilitation for victims of grave violations of human rights and fundamental freedoms.
٤- وأعربت اللجنة كذلك، في قرارها ١٩٩٧/٢٩، عن تقديرها للدول التي وافت اﻷمين العام بمعلومات عن هذا الموضوع، ورجت من الدول التي لم تقم بعد بموافاة اﻷمين العام بمعلومات عن التشريعات التي اعتمدتها فعلا أو التي هي بصدد اعتمادها فيما يتصل بالحق في الاسترداد والتعويض ورد الاعتبار لضحايا الانتهاكات الخطيرة لحقوق الانسان والحريات اﻷساسية أن تفعل ذلك.

61. Principle 36 (1) has been revised in principle 34 (1) by deleting the word " individual " before " measures concerning the right to restitution, compensation and rehabilitation " and by deleting the word " general " before the phrase " measures of satisfaction " .
61- وجرى تنقيح المبدأ 36(1) في المبدأ 34(1) وذلك بحذف كلمة " فردية " التي ترد قبل عبارة " التدابير التي تتعلق بالحق في الاسترداد وفي التعويض المالي وإعادة التأهيل " ، وحذف عبارة " عامة الطابع " الواردتين قبل عبارة " تدابير تكفيرية " .

The right to reparation shall cover all injuries suffered by the victim; it shall include individual measures concerning the right to restitution, compensation and rehabilitation, and general measures of satisfaction as provided by the set of basic principles and rules concerning the right to reparation (see paragraph 41 above).
يجب أن يشمل الحق في التعويض كافة اﻷضرار التي تلحق بالضحية؛ وهو يتضمن، من جهة، تدابير فردية تتعلق بالحق في الاسترداد وفي التعويض المالي وإعادة التأهيل، ومن جهة أخرى تدابير تكفيرية عامة الطابع، مثل التدابير وضمانات عدم التكرار التي تنص عليها مجموعة المبادئ والتوجيهات اﻷساسية المتعلقة بالحق في التعويض )انظر الفقرة ١٤ أعلاه(.
