The State party should ensure that the Gacaca courts system is compatible with the international human rights obligations of the State party, in particular obligations under the Convention relating to basic legal safeguards for a fair trial, and ensure that the remaining cases before the Gacaca are conducted in conformity with these standards.

(a) Take all necessary measures to ensure, in law and in practice, that all persons who are deprived of their liberty are afforded fundamental legal safeguards from the outset of police custody, in the light of the Committee's general comment No. 2 (2008) on the implementation by States parties of article 2, namely:
(أ) اتخاذ جميع التدابير اللازمة لتكفل من الناحية القانونية والعملية تمتع كل الأشخاص سُلبوا حريتهم، منذ اللحظات الأولى للحبس الاحتياطي، بالضمانات القانونية الأساسية في ضوء تعليق اللجنة العام رقم 2(2008)، أي:

(a) Take all necessary measures to ensure, in law and in practice, that all persons who are deprived of their liberty are afforded fundamental legal safeguards from the outset of police custody, in the light of the Committee's general comment No. 2 (2008) on the implementation by States parties of article 2, namely:
(أ) اتخاذ جميع التدابير اللازمة لتكفل من الناحية القانونية والعملية تمتع كل الأشخاص الذين سُلبوا حريتهم، منذ اللحظات الأولى لاحتجازهم لدى الشرطة، بالضمانات القانونية الأساسية في ضوء تعليق اللجنة العام رقم 2(2008)، أي:

With regard to the situation in Belarus, the Committee against Torture stated its deep concern at reports that some death row prisoners were not provided with fundamental legal safeguards (CAT/C/BLR/CO/4, para. 27).
وفيما يتعلق بالوضع في بيلاروس، أعربت لجنة مناهضة التعذيب عن قلقها العميق إزاء التقارير التي تفيد بأن بعض السجناء المحكوم عليهم بالإعدام لا يتمتعون بالضمانات القانونية الأساسية (CAT/C/BLR/CO/4، الفقرة 27).

In 2011, the Committee against Torture (CAT) noted with regret that the system of incommunicado detention had not been reviewed with a view to its abolition, and remained disappointed to learn that incommunicado detainees were not afforded the basic legal safeguards.
وفي عام ٢٠١١، لاحظت لجنة مناهضة التعذيب بأسف أن نظام الحبس الانفرادي لم يُستعرض بهدف إلغائه، وأعربت عن استمرار خيبتها لمّا علمت أن المحتجز في الحبس الانفرادي لا يتمتع بالضمانات القانونية الأساسية(61).
