(ii) Actions by officials, employees or agents of the Government of Iraq or its controlled entities during that period in connection with the invasion and occupation.

For example, a claim by a domestic worker had as its required threshold of proof a stamp in a passport or other travel document showing that he or she left Iraq or Kuwait during a certain period of time during Iraq's invasion and occupation.

The Panel determined that to be eligible for consideration, the claimant must establish that the disappearance or insolvency of the judgement debtor is directly related to the invasion and occupation.V. RECOMMENDATIONS
وخلص الفريق إلى أنه لكي يحق للمطالب أن ينظر في مطالبته، يجب أن يثبت أن اختفاء المدين بمقتضى حكم أو إعساره مرتبط ارتباطاً مباشراً بالغزو والاحتلال.

In any case, as previously noted, Iraq is not exonerated from liability for direct loss or damage resulting from its invasion and occupation of Kuwait by the fact that other causes unrelated to the invasion and occupation might have contributed to the loss or damage.
وعلى أية حال، فكما لوحظ آنفاً، لا يعفى العراق من المسؤولية عن الخسائر أو الأضرار المباشرة الناتجة عن غزوه للكويت واحتلاله لها لمجرد أن أسباباً أخرى لا علاقة لها بالغزو والاحتلال ربما تكون قد أسهمت في هذه الخسائر أو الأضرار.

The Panel further finds that, since the claimant was not able to engage in these trading activities during Iraq's invasion and occupation of Kuwait, such activities were in fact affected by Iraq's invasion and occupation of Kuwait.

The Panel recommends for compensation the serious personal injuries or deaths arising from such accidents as they were directly linked to the Iraqi invasion and occupation of Kuwait.

2. Proof of causal link to the invasion and occupation
٢- إثبات رابطة السببية بالغزو والاحتلال

As employees may leave a company for many reasons including a higher salary or better opportunities with a competitor, the burden of proof lies on the claimant to establish that the departure of its employees was directly related to Iraq's invasion and occupation of Kuwait.
وبالنظر إلى أن الموظفين قد يتركون شركة ما لأسباب كثيرة من بينها الحصول على مرتب أعلى أو فرص أفضل مع منافس لها، فإن عبء الإثبات يقع على عاتق الجهة المطالبة لإثبات أن مغادرة موظفيها كان يتصل مباشرة بالغزو والاحتلال العراقيين للكويت.

With respect to Loan 2, the facts indicate that the claimant's alleged losses were not directly caused by the actions of Iraqi officials in connection with Iraq's invasion and occupation.
72- وفيما يتعلق بالقرض 2، تشير الوقائع إلى أن الخسائر التي يدعي صاحب المطالبة تكبدها لم تكن نتيجة مباشرة للإجراءات التي اتخذها الموظفون العراقيون والمتصلة بالغزو والاحتلال العراقيين.
