وقالت إنها ترى أن الانتفاع المنصف والمعقول بالمجرى المائي الدولي يستبعد بحكم التعريف التسبب في ضرر جسيم لدولة أخرى من دول المجرى المائي.

The latter rule is necessarily general and flexible, and requires for its proper application that States take into account concrete factors pertaining to the international watercourse in question, as well as to the needs and uses of the watercourse States concerned.

١ - تبذل دول المجرى المائي، كل في إقليمها، قصارى جهودها لصيانة وحماية اﻹنشاءات، والمرافق، واﻷشغال الهندسية اﻷخرى المتصلة بالمجرى المائي الدولي.

The principle of relief to natural or juridical persons in the area who suffered harm as a result of activities related to an international watercourse should be established in article 32 at a subsequent stage or through international watercourse agreements concluded by States in the light of the draft articles.
إذ أن مبدأ منح سبل الانتصاف لﻷشخاص الطبيعيين أو الاعتباريين المصابين في المنطقة يقرر نتيجة ﻷنشطة تتصل بالمجرى المائي الدولي ينبغي أن يحــدد فـي الفقرة ٣٢ في مرحلة لاحقة أو من خلال اتفاقات بشأن المجاري المائيـة الدولية تبرمها الدول في ضوء مشروع المواد.

ولن تثار مسألة حصول الرعايا اﻷجانب على هذا الحق إلا في حال عدم وجود اتفاق بين دول المجرى المائي المعنية بشأن حماية مصالح اﻷشخاص الطبيعيين أو القانونيين، الذين نالهم أو الذين يتهددهم جديا ضرر جسيم عابر للحدود، نتيجة ﻷنشطة تتعلق بالمجرى المائي الدولي.

" 1. Watercourse States shall in their respective territories utilize an international watercourse or transboundary aquifer in an equitable and reasonable manner.
" ١ - تنتفع دول المجرى المائي، كل منها في اقليمها، بالمجرى المائي الدولي أو " مستودع المياه الجوفية العابر للحدود بطريقة منصفة ومعقولة.

" 1. Utilization of an international watercourse or transboundary aquifer in an equitable and reasonable manner within the meaning of article 5 requires taking into account all relevant factors and circumstances, including:
" ١ - يتطلب الانتفاع بالمجرى المائي الدولي أو مستودع المياه الجوفية العابر للحدود بطريقة منصفة ومعقولة بالمعنى المقصود في المادة ٥ أخذ جميع العوامل والظروف ذات الصلة في الاعتبار، ومنها ما يلي:

15. The first problem, concerning paragraph 1, related to the question whether utilization of an international watercourse that caused significant harm could still be considered equitable.
١٥ - والمشكلة اﻷولى، وهي تتعلق بالفقرة ١، ترتبط بمسألة ما إذا كان الانتفاع بالمجرى المائي الدولي الذي يتسبب في ضرر جسيم يمكن أن يظل يعتبر انتفاعا منصفا.

In article 23, entitled " Protection and preservation of the marine environment " , the text originally proposed by the Commission had provided that watercourse States should " individually or jointly " take all measures with respect to an international watercourse that were necessary to protect and preserve the marine environment.
