86 - وتستمر مناقشة المسائل المتصلة بالموارد الجينية البحرية في المناطق الواقعة خارج نطاق الولاية الوطنية في الاجتماع الخامس للفريق العامل المخصص غير الرسمي المفتوح باب العضوية.

In that regard, divergent views were expressed on the relevant legal regime on marine genetic resources beyond areas of national jurisdiction, in particular whether those marine genetic resources were part of the common heritage of mankind and therefore fell under the regime for the Area, or were part of the regime for the high seas.

At the 2008 meeting of the Working Group, the need for capacity-building for developing countries to participate in and benefit from activities related to marine genetic resources beyond areas of national jurisdiction was underlined, as was the need to enhance the sharing of scientific information and results.

70. Delegations generally recognized that the Convention provided the framework for all activities in the oceans and seas, including in respect of marine genetic resources beyond areas of national jurisdiction.

71. Divergent views were expressed on the relevant legal regime under the Convention regarding marine genetic resources beyond areas of national jurisdiction.

15. Delegations recalled that the United Nations Convention on the Law of the Sea provided the legal framework for all activities in the oceans and seas, including with respect to marine genetic resources beyond areas of national jurisdiction.
15 - أشارت الوفود إلى أن اتفاقية الأمم المتحدة لقانون البحارتوفر الإطار القانوني لجميع الأنشطة في المحيطات والبحار، بما في ذلك ما يتعلق منها بالموارد الجينية البحرية في المناطق الواقعة خارج نطاق الولاية الوطنية.

It was underlined that the Working Group was the appropriate forum to discuss issues relating to marine genetic resources beyond areas of national jurisdiction and that such discussion should be conducted within the framework of, and in conformity with, the Convention.

331. The issue of marine genetic resources is not only an emerging issue, having started to be considered by various forums relatively recently, but it also presents a number of challenges, in particular as regards marine genetic resources beyond areas of national jurisdiction.
331 - وليست مسألة الموارد الجينية البحرية مسألة ناشئة فحسب، بعد أن أخذت مختلف المنتديات بالنظر فيها في الآونة الأخيرة نسبيا، ولكنها تطرح أيضا عددا من التحديات، ولا سيما في ما يتعلق بالموارد الجينية البحرية في المناطق الواقعة خارج نطاق الولاية الوطنية.

49. Some delegations expressed the view that an access and benefit-sharing regime relating to marine genetic resources of areas beyond national jurisdiction was not needed or even desirable.

56. Some delegations suggested that a public trusteeship could be established to collect and distribute royalties and benefits relating to marine genetic resources of areas beyond national jurisdiction.
٥٦ - واقترح بعض الوفود إنشاء هيئة وصاية عامة لتحصيل وتوزيع العوائد والمنافع المتصلة بالموارد الجينية البحرية في المناطق الواقعة خارج نطاق الولاية الوطنية.

46. Many delegations considered that such a legal gap existed in the current legal framework in respect of marine genetic resources of areas beyond national jurisdiction, in particular in relation to access and the sharing of benefits arising from their exploitation, while some delegations considered that there was no such gap.

The discussions on the topic of focus also addressed, inter alia, existing tools and instruments as well as possible options for the conservation and management of marine biodiversity in areas beyond national jurisdiction, and activities related to marine genetic resources in areas beyond national jurisdiction.

169. From a policy and legal perspective, issues related to the relevant legal regime with respect to marine genetic resources in areas beyond national jurisdiction continued to be discussed at the fourth meeting of the Ad Hoc Open-ended Informal Working Group.
