Regarding the new topics to be considered by the Commission, its study of the formation and evidence of customary international law should result in a short, practical guide, not overly prescriptive, for judges, both domestic and international, practitioners, government lawyers and legal advisers of non-governmental organizations.
وفيما يتعلق بالمواضيع الجديدة المقرر أن تنظر فيها اللجنة، قال إن قيامها بدراسة موضوع نشوء القانون الدولي العرفي وأدلته ينبغي أن يؤدي إلى وضع دليل عملي قصير غير مفرط في جانبه التوجيهي، للقضاة المحليين والدوليين، والممارسين ومحامي الحكومات، والمستشارين القانونيين للمنظمات غير الحكومية.

47. With respect to the five new topics proposed by the Commission, her delegation was of the view that the topic on the formation and evidence of customary international law was most in line with the Commission's mandate to promote the codification and progressive development of international law.

63. Concerning the Commission's new topics for future work, the formation and evidence of customary law were key questions that were raised in many situations.
63 - وفيما يختص بالمواضيع الجديدة التي ستشملها أعمال لجنة القانون الدولي المقبلة، تمثل نشأة القانون العرفي وإثبات ذلك القانون مسألتين رئيسيتين تُطرحان في حالات عديدة.

With regard to the new topics in the Commission's long-term programme of work, her delegation particularly welcomed the inclusion of the topics of formation and evidence of customary international law and the fair and equitable treatment standard in international investment law.
وفيما يختص بالمواضيع الجديدة في برنامج عمل لجنة القانون الدولي الطويل الأجل، يرحب وفدها على نحو خاص بإدراج مواضيع نشأة القانون الدولي العرفي، وإثبات ذلك القانون، ومعيار المعاملة العادلة المنصفة في قانون الاستثمار الدولي.

23. Concerning the new topics proposed for the Commission's long-term programme of work, his delegation continued to hold the view that the topic " The most-favoured-nation clause " was not appropriate for progressive development or codification.

47. As for the new topics to be included in its work programme, the Commission should investigate questions which had a beneficial impact on developing countries, more particularly the protection of persons in the event of disasters and the most-favoured-nation clause.
47 - واختتم قائلا إنه فيما يتعلق بالمواضيع الجديدة التي يتعين إدراجها في برنامج عملها، ينبغي أن تبحث اللجنة المسائل التي كان لها أثر مفيد على البلدان النامية، وبالأخص حماية الأشخاص في حالات الكوارث وشرط الدولة الأولى بالرعاية.

With regard to new topics in the Commission's programme of work, his delegation supported the Working Group's recommendation that the Commission should include the topic of the most-favoured-nation clause; it could play a useful role in providing clarification on the meaning and effect of such clauses in the field of investment agreements.
76 - وفيما يتعلق بالمواضيع الجديدة في برنامج عمل اللجنة، يؤيد وفد بلده توصية الفريق العامل بأن على اللجنة أن تُدرج موضوع شرط الدولة الأولى بالرعاية؛ فهو قد يمكن أن يؤدي دورا مفيدا في توفير إيضاحات بشأن معنى وأثر تلك الشروط في مجال اتفاقات الاستثمار.

78. Her delegation took note of the new topics which the Commission had included in its programme of work (Protection of the environment in relation to armed conflicts, and Protection of the atmosphere).
78 - واستطردت قائلة إن وفد بلدها يحيط علما بالمواضيع الجديدة التي أدرجتها اللجنة في برنامج عملها (حماية البيئة فيما يتعلق بالنزاعات المسلحة وحماية الغلاف الجوي).

55. With regard to the new topics included in the Commission's programme of work, her delegation continued to have doubts about the idea of developing the topic " Protection of the atmosphere " .
55 - وفيما يتصل بالمواضيع الجديدة الواردة ضمن برنامج عمل اللجنة فقد أعربت عن شكوك ما زالت تساور وفدها إزاء فكرة مسألة " حماية الغلاف الجوي " .

46. With regard to the new topics that had been endorsed by the Commission for inclusion in its long-term programme of work, his Government would be particularly interested in the Commission's views on the formation and evidence of customary international law, which had enormous significance for regulating the affairs of States, yet its sources were not always easy to find and apply.
46 - وفيما يتعلق بالمواضيع الجديدة التي أقرت اللجنة إدراجها في برنامج عملها الطويل الأجل، قال إن حكومته ستسهم بشكل خاص بآراء اللجنة بشأن موضوع نشوء القانون الدولي العرفي وأدلته الذي ينطوي على أهمية كبيرة بالنسبة لتنظيم شؤون الدول، والذي يصعب دائما العثور على مصادره وتطبيقها.

He therefore encouraged the Commission to bring its work on preventive measures to fruition, to complete the first reading of a complete set of articles on State responsibility and to bear in mind the possibility of the early submission of reports or studies on new topics to the Committee, on the basis of which the General Assembly could determine the direction of future work.

Thematic assessments (including assessments on new topics identified by science) provide important opportunities to raise awareness and understanding of emerging issues, to address highpriority specific needs and to provide timely answers to urgent policy-relevant questions.

It was the understanding of the European Union that paragraph 5, which took note of the new subjects proposed at the 2010 session of the Special Committee, did not prejudge the recommendations which the Sixth Committee would make at the sixty-sixth session regarding its agenda.
