49. The legal aid provisions are contained in articles 6 and 8 of directive 1/94 on the Assignment of Defence Counsel.

(a) Directive on the Assignment of Defence Counsel

The 1998 revised estimate for defence counsel was based on the expenditure forecasts in August 1998, considering the increased number of detainees and potential obligations according to the guidelines in the directive on Assignment of Defence Counsel.
وقد استندت التقديرات المنقحة لمحامي الدفاع إلى إسقاطات النفقات في آب/أغسطس ١٩٩٨، نظرا إلى زيادة عدد المحتجزين والالتزامات المحتملة وفقا للمبادئ التوجيهية الواردة في التوجيه اﻹداري المتعلق بتعيين محامي الدفاع.

34. Pursuant to the statute, the Rules and various directives, the President of the Tribunal is entrusted with the right of final review pertaining to matters such as the enforcement of sentences, legal aid/defence counsel issues and the application of such directives as the Rules of Detention and the Directive on the Assignment of Defence Counsel.

7. On 2 April 1998, the Registrar convened at Arusha a meeting of the advisory panel contemplated in article 29 of the Directive on Assignment of Defence Counsel to review, inter alia, the issue of remuneration of defence counsel under the legal aid programme.
7 - وفي 2 نيسان/أبريل 1998، عقد رئيس قلم المحكمة اجتماعا في أروشا للفريق الاستشاري المرتأى في المادة 29 من " التوجيه المتعلق بتعيين محامي الدفاع " وذلك لاستعراض مسائل من بينها مسألة تحديد أجر محامي الدفاع في إطار برنامج المعونة القانونية.

5. The precondition for payment of fees and expenses is that such are agreed by the Registrar as being both necessary and reasonable (article 17 of the Directive on the Assignment of Defence Counsel) for the conduct of the accused's defence.

216. One of the key documents for the defence is the Directive on the Assignment of Defence Counsel. This official document was promulgated by the Head of the Defence Office with the approval of the plenary of judges. It was adopted during the judges' plenary session held in March 2009.
216 - تشكل المبادئ التوجيهية الخاصة بتعيين محامي الدفاع إحدى أبرز الوثائق بالنسبة إلى الدفاع، وقد أصدر رئيس مكتب الدفاع هذه الوثيقة الرسمية بموافقة الهيئة العامة للقضاء، واعتُمد خلال جلسة الهيئة التي انعقدت في شهر آذار/مارس 2009.

In addition, the fixed rate set forth by article 22 of the Directive on the Assignment of Defence Counsel and payable at the end of each stage of the proceedings (pre-trial/trial/appeal) was fixed at $400.

The purpose of the meeting will be twofold: (a) to elect the President of the Special Tribunal; and (b) to adopt a schedule for the drafting of the rules of procedure and evidence and other necessary documents (such as the directives on the Assignment of Defence Counsel, on the detention of persons awaiting trial or appeal and on the code of professional conduct for defence counsel).
