Under the Environmental Impact Assessment Directive and the Integrated Pollution Prevention and Control Directive, member States of the European Union are obliged to advise bordering States of any proposals that could have an impact on the environment in those States and there is therefore a formal procedure for exchanging applications relating to environmental impact assessments and atmospheric emissions.

38. In relation to the environmental impacts of activities related to marine renewable energy, the provisions on environmental impact assessments in article 14 of the Convention on Biological Diversity (Treaty Series, vol. 1760, No. 30619), which apply to processes and activities, regardless of where their effects occur, carried out under its parties' jurisdiction or control, are to be borne in mind.
