138. Pursuant to the recommendation of the Special Rapporteur on the situation of human rights in Zaire and Commission on Human Rights resolution 1995/69 on the situation of human rights in Zaire, the High Commissioner has been working towards establishing a human rights presence in Zaire.
٨٣١- عملاً بتوصية المقرر الخاص المعني بحالة حقوق اﻹنسان في زائير وقرار لجنة حقوق اﻹنسان ٥٩٩١/٩٦ بشأن حالة حقوق اﻹنسان في زائير، يسعى المفوض السامي الى إنشاء وجود لحقوق اﻹنسان في زائير.

571. The Special Rapporteur is seriously concerned about the recent events in Zaire and can only share the fears expressed by the Special Rapporteur on the situation of human rights in Zaire, to the effect that the explosion of the political situation in Zaire would have effects considerably more serious than in Rwanda or Burundi.
١٧٥- وإذ يعرب المقرر الخاص عن قلقه البالغ لﻷحداث التي وقعت مؤخراً في البلد فإنه يشارك في المخاوف التي أعرب عنها المقرر الخاص المعني بحالة حقوق اﻹنسان في زائير من أن يؤدي انفجار الحالة السياسية في زائير إلى آثار تفوق كثيراً اﻵثار التي حدثت في رواندا أو بوروندي.

The information received concerns 33 alleged violations, which are different from those already mentioned by the Special Rapporteur on the situation of human rights in Zaire in his preliminary report.4

(b) The Special Rapporteur on the situation of human rights in Zaire attributes the practice of arbitrary detentions in that country to the anarchy in the powers of the security services, which are all authorized de jure or de facto to carry out arrests (E/CN.4/1995/67, para. 184);

55. The Sub-Commission on Prevention of Discrimination and Protection of Minorities suggested to the Special Rapporteurs on the situation of human rights in Zaire and Burundi that they should examine the role played by Radio Démocratie and other media in spreading genocidal conduct (resolution 1995/4).
٥٥- اقترحت اللجنة الفرعية لمنع التمييز وحماية اﻷقليات على المقررين الخاصين المعنيين بحالة حقوق اﻹنسان في زائير وبوروندي أن يبحثا في الدور الذي تضطلع به محطة إذاعة تدعى " إذاعة الديمقراطية " )Radio Démocratie( وغيرها من وسائل اﻹعلام في نشر سلوك اﻹبادة الجماعية )القرار ٥٩٩١/٤(.

It should not be forgotten that the Banyamulenge, who admitted to the Special Rapporteur on the situation of human rights in Zaire that they were arming themselves in self-defence,24 are members of the Alliance and that many of them joined the ranks of the Rwandan Patriotic Front, whose victory triggered the exodus of Rwandan refugees to Zaire and the United Republic of Tanzania.
وينبغي ألا ننسى أن البانيامولينغين الذين اعترفوا أمام المقرر الخص المعني بحالة حقوق اﻹنسان في زائير بأنهم يتسلحون من أجل الدفاع عن أنفسهم)٤٢( هم أعضاء في التحالف وأن عددا منهم انخرط في صفوف الجبهة الوطنية الرواندية، التي يعتبر انتصارها السبب اﻷصلي في الهجرة الجماعية للاجئين إلى زائير وتنزانيا.

This is why the Special Rapporteur on the situation of human rights in Zaire attributes responsibility for the violence to them, stating that: “The Hutu militia known as the Interahamwe have been the main instigators of violence” (E/CN.4/1997/Add.1, para. 38).
وهذا ما دفع المقرر الخاص المعني بحالة حقوق اﻹنسان في زائير إلى عزو مسؤولية انتشار العنف إلى تلك الجماعات. فقد كتب المقرر الخاص قائلا: " وكانت ميليشيات الهوتو المعروفة باسم إنتيراهاموي )المهاجمين معاً( هي المنفّذ الرئيسي ﻷعمال العنف " E/CN.4/1997/6/Add.1)، الفقرة ٨٣(.

(b) He had asked the Special Rapporteur of the Commission on Human Rights on the situation of human rights in Zaire to investigate the allegations of massacres and make recommendations to the Commission on Human Rights at its forthcoming session, which was to begin the following week.

In mid-1996, reports of worsening conflict in Zaire, indicating that acts of violence in Rutshuru, Masisi, Wlikale and elsewhere were driving a large number of Zairians into Rwanda, prompted the High Commissioner for Human Rights to ask the Special Rapporteur on the situation of human rights in Zaire to conduct an investigation in situ.
٠٢- في منتصف عام ٦٩٩١ أشارت التقارير عن تفاقم الصراع في زائير إلى أعمال عنف في روتوشورو، وماسيسي، ووليكال وغيرها، تدفع بأعداد كبيرة من الزائيريين إلى داخل رواندا، مما حدا بالمفوض السامي لشؤون حقوق اﻹنسان إلى أن يطلب من المقرر الخاص المعني بحالة حقوق اﻹنسان في زائير أن يحقق في اﻷمر ميدانياً في الموقع.

In the light of the information he has received, the Special Rapporteur considers that the conclusion of the Special Rapporteur on the situation of human rights in Zaire in his 1996 report to the Commission remains applicable: “torture, cruel, inhuman and degrading treatment, and the rape of women prisoners ... have not ceased” (E/CN.4/1996/66, para. 121).
٤١٢- على ضوء المعلومات التي تلقاها، يرى المقرر الخاص أن الاستنتاج الذي توصل إليه المقرر الخاص المعني بحالة حقوق اﻹنسان في زائير في تقريره لعام ٦٩٩١ المقدم إلى اللجنة، ما فتئ سليما: " إن التعذيب والمعاملـة القاسيـة أو اللاإنسانيـة أو المهينـة واغتصـاب السجينـات ما فتئ يحدث " E/CN.4/1996/66)، الفقرة ١٢١(.

81. Lastly, the Special Rapporteur supports the proposal made by the Special Rapporteur on the human rights situation in Zaire in his forthcoming report to the Commission on Human Rights at its fifty-third session requesting a special session of the Commission devoted to the most urgent problems of the Great Lakes region.
