Regarding the prohibition of racial discrimination in general, the Committee is further concerned that racial discrimination as such is not explicitly and adequately penalized in criminal law.

70. The Committee notes that the State party has not yet established an independent institution with the mandate to monitor and promote human rights, including on issues relating to the prohibition of racial discrimination and the promotion of tolerance amongst ethnic groups (arts. 2, 6 and 7).

The Committee regrets that the National Human Rights Observatory ceased to exist in accordance with the Transitional Constitution and notes that the State party has not yet set up an analogous independent body to promote and monitor the enjoyment of human rights, particularly in areas relating to the prohibition of racial discrimination and the promotion of tolerance among ethnic groups.

Noting article 172 of the Bahraini Penal Code, article 41 of the Press and Publication Act No. 14 of 1979, and the Social and Cultural Associations and Clubs, Private Institutions and Sports Organizations Act No. 21 of 1989, the Committee is concerned that existing legislation concerning the prohibition of racial discrimination is conditional upon an action being contrary to public peace, order or morality.
51- وتحيط اللجنة علماً بالمادة 172 من قانون العقوبات البحريني والمادة 41 من قانون الطباعة والنشر لعام 1979 والقانون رقم 21 بشأن الجمعيات والأندية الاجتماعية والثقافية والهيئات الخاصة العاملة في ميدان الشباب والرياضة والمؤسسات الخاصة لعام 1989، وتعرب عن قلقها لأن التشريع القائم المتعلق بحظر التمييز العنصري مرهون بتنافي فعل ما مع الأمن العام أو النظام العام أو الأخلاق العامة.
