29. The Committee is concerned that the lack of recognition of some indigenous peoples by the State party prevents them from fully enjoying their cultural rights, which are deeply rooted in their ancestral lands, territories and resources (art. 15).
29- تُعرب اللجنة عن قلقها لأن عدم اعتراف الدولة الطرف ببعض الشعوب الأصلية يحول دون تمتع هذه الشعوب تمتعاً كاملاً بحقوقها الثقافية الراسخة الجذور في الأراضي والأقاليم والموارد التي توارثتها هذه الشعوب عن أسلافها (المادة 15).

While noting the information provided in the replies to the list of issues, the Committee is concerned at the lack of data to allow the identification of ethnic and religious groups and minorities in the territory of the State Party and which limits, inter alia, the full enjoyment of their cultural rights (art. 15).
32- وتلاحظ اللجنة المعلومات المقدمة في الردود على قائمة المسائل، لكنها تشعر بالقلق إزاء عدم توافر بيانات تيسّر تحديد الفئات والأقليات الإثنية والدينية في إقليم الدولة الطرف وهو ما يحدّ، في جملة أمور، من تمتعها الكامل بحقوقها الثقافية (المادة 15).

In 1997, in its general comment No. 23 on the rights of minorities (CCPR/C/21/Rev.1/Add.5), the Human Rights Committee noted the need to ensure effective participation of indigenous peoples in decisions that affect them in order for them to enjoy their cultural rights protected under the International Covenant of Civil and Political Rights.
وقد لاحظت اللجنة المعنية بحقوق الإنسان، في تعليقها العام رقم 23 على حقوق الأقليات (CCPR/C/21/Rev.1/Add.5)، ضرورة ضمان مشاركة الشعوب الأصلية مشاركة فعالة في صنع القرارات التي تؤثر عليها وذلك تمكيناً لها من التمتع بحقوقها الثقافية المحمية بموجب العهد الدولي الخاص بالحقوق المدنية والسياسية.
