It was agreed that Ecuador and Peru would consider the following matters in good faith, in accordance with the Rio de Janeiro Protocol of Peace, Friendship and Boundaries of 1942 and its supplementary instruments, and on the basis of the Itamaraty Peace Declaration of 1995:

The two groups shall submit to the commission their views, relating to technical matters and in accordance with the law, on the disagreements which have been submitted for consideration and on the ways to establish on the ground the common border, pursuant to article VIII of the Rio de Janeiro Protocol and its additional instruments, which shall be evaluated from the legal point of view by the respective groups.
وسيقدم الفريقان إلى اللجنة آراء تعنى بالمسائل التقنية وبمطابقة القانون، فيما يتعلق بالخلافات التي تكون عرضت عليهما وبشأن التحديد الموقعي للحدود المشتركـة، وفقا للمادة الثامنة من بروتوكول ريو دي جانيرو والصكوك التكميلية له التي سيقوم الفريقان بتقييمها من الناحية القانونية.

That since the latest conflict, in 1995, substantive talks have been undertaken within the framework of the Rio de Janeiro Protocol of Peace, Friendship and Boundaries of 1942, the Braz Dias de Aguiar award and other supplementary instruments with a view to completing the placement of markers within the framework of a comprehensive and lasting agreement.
وأنه ابتداء من النزاع اﻷخير الذي وقع في عام ١٩٩٥، أجريت محادثات موضوعية في إطار بروتوكول ريو دي جانيرو للسلم والصداقة والحدود لعام ١٩٤٢، وقرار تحكيم براس دياس دي أغيار والصكوك التكميلية اﻷخرى، بهدف أن تفضي إلى وضع علامات الحدود من خلال اتفاق شامل ونهائي.

That after the positions of the two countries with regard to the elimination of differences had been substantially reconciled, within the framework of the Rio de Janeiro Protocol of Peace, Friendship and Boundaries of 1942, an impasse developed in the final stage of the talks that could have brought the process to a halt, creating the risk of further armed conflicts.
وأنه بعد تحقق تقارب كبير بين موقفي البلدين من التغلب على الخلافات، وذلك على الدوام في إطار بروتوكول ريو دي جانيرو للسلم والصداقة والحدود لعام ١٩٤٢، وصلت المحادثات في المرحلة اﻷخيرة إلى حالة من الركود كان يمكن أن تؤدي إلى جمود العملية مع ما يترتب على ذلك من خطر نشوب نزاعات مسلحة جديدة.

This legal approach is required by the framework linking the two countries, consisting of the Rio de Janeiro Protocol of Peace, Friendship and Boundaries of 1942, and the Braz Dias de Aguiar award, and by the progress made during the process initiated with the Itamaraty Declaration of Peace.
ويتحدد هذا المنظور القانوني في اﻹطار الملزم لكلا البلدين الذي يشكله بروتوكول ريو دي جانيرو للسلم والصداقة والحدود لعام ١٩٤٢، وقرار تحكيم براس دياس دي أغيار، وكذلك التقدم المحرز في سير العملية التي بدأت بإعلان إيتاماراتي للسلم.

In that connection, and in accordance with article 1 of the Rio de Janeiro Protocol of Peace, Friendship and Boundaries of 1942, they solemnly reaffirm their rejection of the threat or use of force in relations between Peru and Ecuador and of all acts that may undermine peace and friendship between the two nations.
وفي هذا الصدد، ووفقا للمادة اﻷولى من بروتوكول ريو دي جانيرو للسلم والصداقة والحدود المبرم في عام ١٩٤٢، يؤكدان رسميا التخلي عن التهديد باستعمال القوة واستعمالها في العلاقات بين بيرو وإكوادور، فضلا عن أي فعل يضر بالسلم والصداقة بين البلدين.

2. The Guarantor Countries noted with satisfaction that it was possible, within the framework of the Rio de Janeiro Protocol of 1942, to follow the path of a peaceful solution to the conflict between two American nations, which constitutes a threat to the peace and prosperity of the region.
٢ - وتشير البلدان الكفيلة مع الارتياح إلى أنه تم، في إطار بروتوكول ريو دي جانيرو لعام ١٩٤٢، التمسك بطريق الحل السلمي لهذا النزاع بين الدولتين اﻷمريكيتين، الذي يشكل تهديدا لسلم وازدهار المنطقة.

In 1947, an aerial survey carried out by the United States Air Force at the request of the two countries helped establish the line which, in keeping with the arbitral verdict should follow the border in the Cordillera del Cóndor, between the source of the Quebrada de San Francisco and the confluence of the Yaupi and Santiago rivers, referred to in article 8 of the Rio de Janeiro Protocol.

We believe that in the current circumstances and by virtue of point 4 of the Santiago Agreement, the view of the Guarantor Countries of the Protocol should be binding on the Parties if the procedure requested by you is to permit the resolution of the difficulties encountered in the process initiated with the Itamaraty Declaration and the attainment of the objectives of peace and friendship within the framework of the Rio de Janeiro Protocol.
ومن ثم، نعتقد في ظل الظروف الحالية وبموجب البند الرابع من اتفاق سنتياغو، أنه لكي يتيح اﻹجراء الذي طلبتموه التغلب على الصعوبات المواجهة في العملية التي بدأت بإعلان إيتاماراتي للسلم وتحقيق مقترحات السلم والصداقة في إطار بروتوكول ريو دي جانيرو ينبغي أن تأخذ وجهة نظر البلدان الضامنة للبروتوكول طابع اﻹلزام بالنسبة للطرفين.

That article 7 of the Rio de Janeiro Protocol of Peace, Friendship and Boundaries of 1942 provides that “any doubt or disagreement which may arise over the execution of this Protocol shall be resolved by the Parties with the assistance of the representatives of the United States, Argentina, Brazil and Chile within the shortest period possible”.
وأن المادة السابعة من بروتوكول ريو دي جانيرو للسلم والصداقة والحدود لعام ١٩٤٢ قد تﱠوخي فيها " أن يقوم الطرفان بحسم أي شك أو خلاف قد ينشأ بصدد تنفيذ هذا البروتوكول، بمساعدة ممثلي الولايات المتحدة واﻷرجنتين والبرازيل وشيلي في أقرب وقت ممكن " .

The two groups shall submit opinions to the Commission, having due regard to technical considerations and in accordance with law, on the areas of disagreement presented to them and on measures for the physical demarcation of a common boundary, in accordance with article eight of the Protocol of Rio de Janeiro and the supplementary instruments thereof, which shall be evaluated by the respective groups from a legal perspective.
وبعد أن ينظر الفريقان في المسائل الفنية والقانونية، يعرضان على اللجنة آراءهما بشأن أوجه الخلاف التي تكون قد عُرضت عليهما، وبشأن تدابير ترسيم الحدود البرية المشتركة على الطبيعة، وفقا للمادة الثامنة من بروتوكول ريو دي جانيرو والصكوك المكملة له. ويتولى الفريقان تقييم هذه التدابير من الناحية القانونية.

1. The Governments of Ecuador and Peru shall focus their attention, in good faith, on the following initiatives with a view to reaching an agreement on the basis of the Protocol of Rio de Janeiro of Peace, Friendship and Boundaries of 1942 and its supplementary instruments, in accordance with the Itamaraty Declaration of Peace of 1995:
١ - تدرس حكومتا إكوادور وبيرو، بدقة وبحُسن نية، المبادرات التالية الرامية إلى تحقيق تفاهم على أساس بروتوكول ريو دي جانيرو للسلام والصداقة والحدود لسنة ١٩٤٢ والصكوك المكملة له، وذلك بموجب إعلان إيتاماراتي للسلام الصادر في عام ١٩٩٥:
