While it welcomes the existence of a mechanism to investigate complaints made against the police force, namely the Garda Complaints Board, the Committee regrets that the Board is not fully independent, in that investigations of complaints against the Garda are often entrusted to members of the Garda without consultation with the Board.

The Committee requests that the State party include in its next periodic report available information on complaints lodged, including those submitted to the National Human Rights Commission, and prosecutions launched, as well as penalties imposed, in cases of offences which relate to racial discrimination.

54. Mr. Leutert (Switzerland), referring to the fact that the information on complaints filed against the police covered eight cantons only, said that statistics were collected in other cantons too, for example in the canton of Basel-Land, but that was not done systematically.
