109. The draft articles on nationality of natural persons in relation to the succession of States are primarily concerned with the prevention of statelessness.

The Commission considered the Report of the Chairman of the Working Group (A/CN.4/L.572) at its 2572nd meeting, on 14 May, and referred the draft preamble and a set of 26 draft articles (hereinafter “draft articles on nationality of natural persons in relation to the succession of States”) to the Drafting Committee.

In its resolution 55/153 of 12 December 2000, the Assembly took note of the draft articles and reiterated its invitation to Governments to submit comments and observations on the question of a convention on nationality of natural persons in relation to the succession of States, and decided to revisit this question at its fiftyninth session.
وأحاطت الجمعية العامة علماً، في قرارها 55/153 المؤرخ 12 كانون الأول/ديسمبر 2000، بمشروع المواد وكررت دعوتها إلى الحكومات لتقديم التعليقات والملاحظات على مسألة وضع اتفاقية بشأن جنسية الأشخاص الطبيعيين في حالة خلافة الدول، وقررت إعادة النظر في هذه المسألة في دورتها التاسعة والخمسين.

Likewise, the European Convention on Nationality of 6 November 1997 and the Commission's articles on nationality of natural persons in relation to the succession of States, of which the United Nations General Assembly took note on 12 December 2000, are based on the principle of the right to a nationality.

Under the terms of the draft resolution, the Assembly would, inter alia, invite Governments to submit comments on the advisability of drafting a legal instrument on the nationality of natural persons in relation to the succession of States and would decide to consider the agenda item again at its sixty-third session.

2. It is of the utmost importance that there should be an international instrument that compiles and harmonizes conventional and customary law on the nationality of natural persons in relation to the succession of States.

48. The International Law Commission adopted the draft articles on the nationality of natural persons in relation to the succession of States at its fifty-first session.
