The Committee refers the State party to its general comment No. 4 (1991) on the right to adequate housing and its general comment No. 7 (1997) on forced evictions (art. 11).

The Committee urges the State party to adopt the proper legal framework regulating the conduct of urbanization projects to ensure that persons forcibly evicted are provided with adequate compensation and/or relocation taking into the guidelines adopted by the Committee in its general comment No. 7 on forced evictions.
تحث اللجنة الدولة الطرف على اعتماد إطار قانوني ملائم ينظم سير مشاريع التوسع الحضري لضمان إعطاء الأشخاص الذين جرى إخلاؤهم قسرا تعويضا مناسبا و/أو نقلهم بصورة تراعي المبادئ التوجيهية التي اعتمدتها اللجنة في تعليقها العام رقم 7 بشأن حالات الإخلاء القسري.

The Committee also recommends that the State party take steps to ensure that Roma communities are consulted throughout eviction procedures, afforded due process guarantees and provided with alternative accommodation or compensation enabling them to acquire adequate accommodation, and that the State party take into account the Committee's general comment no. 7 (1997) on forced evictions.
وتوصي اللجنة الدولة الطرف أيضاً بأن تتخذ خطوات لضمان مشاورة مجتمعات الروما طوال إجراءات الإخلاء، وتزويدهم بالضمانات الواجبة وتوفير السكن البديل لهم وتعويضهم بشكل يمكنهم من الحصول على سكن لائق، وينبغي أن تراعي الدولة الطرف تعليق اللجنة العام رقم 7(1997) بشأن حالات الإخلاء القسري.

وتوصي اللجنة أيضاً بأن تتخذ الدولة الطرف الخطوات التي تضمن لضحايا الإخلاء القسري حصولهم على سكن بديل أو تعويضهم بسكن ملائم وفقاً للمبادئ التوجيهية التي اعتمدتها اللجنة في تعلقيها العام رقم 7(1997) بشأن حالات الإخلاء القسري.

Support on data collection, referrals for social services, prevention of rights violations and communication to the Protection Cluster and its national and international member organizations; and support on the development of a policy paper and standard operating procedures on forced evictions from camps of displaced persons for the members of the Protection Cluster

In this connection, the Committee reminds the State party of its obligations under article 11 of the Covenant and refers to its General Comments No. 4 (1991) on the right to adequate housing (art. 11, para. 1, of the Covenant) and No. 7 (1997) on forced evictions, to guide the Government's housing policies.
وفي هذا الصدد، تذكِّر اللجنة الدولة الطرف بالتزاماتها بموجب المادة 11 من العهد وتشير إلى تعليقيها العامين رقم 4 (1991) بشأن الحق في السكن الملائم (الفقرة 1 من المادة 11 من العهد) ورقم 7 (1997) بشأن حالات الإخلاء القسري للمساكن، الصادرين لتوجيه السياسات الحكومية في مجال الإسكان.

Where appropriate, the Special Rapporteur has joined in urgent actions on forced evictions with other special procedures, i.e. the Special Rapporteur on the question of torture, the Special Rapporteur on migrants, the Special Rapporteur on the situation of human rights and fundamental freedoms of indigenous people, the Special Rapporteur on the right to health and the Working Group on Arbitrary Detention.

The Committee urges the State party to take urgent measures to consult affected communities throughout all stages of evictions, to ensure due process guarantees and compensation and to provide in particular for adequate alternative accommodation in locations suitable for social housing construction, taking into account the Committee's general comments No. 4 (1991) and 7 (1997) on the right to adequate housing and on forced evictions.
