" 2- في اجراءات الاعسار التي تستهل في دولة غير الدولة التي يقع فيها مقر المحيل، اذا نشأ أي حق تفضيلي بمقتضى قانون دولة المحكمة وأعطي الأولوية على حقوق محال اليه في اجراءات اعسار تنظم في اطار قانون تلك الدولة، تكون لذلك الحق تلك الأولوية بصرف النظر عما تنص عليه المادة 24.

2. notwithstanding paragraph 1 of this article, this Convention prevails over the Unidroit Convention on International Factoring ( " the Ottawa Convention " ).
2 - بصرف النظر عما تنص عليه الفقرة 1 من هذه المادة، تكون لهذه الاتفاقية الغلبة على اتفاقية المعهد الدولي لتوحيد القانون الخاص (اليونيدروا) بشأن العولمة الدولية ( " اتفاقية أوتاوا " ).

2- في اجراءات الاعسار التي تُستهل في دولة غير الدولة التي يقع فيها مقر المحيل، يجوز، بصرف النظر عما تنص عليه المادة 24 اعطاء الأولوية لأي حق تفضيلي ينشأ، باعمال القانون، بمقتضى قانون دولة المحكمة وتُعطى له صفة الأولوية على حقوق محال اليه في اجراءات الاعسار التي تُنظم بمقتضى قانون تلك الدولة.

Pakistan's instrument is therefore considered by the depositary as taking immediate effect, notwithstanding article 20, paragraph 4 (c), of the 1969 Vienna Convention.
ومن ثم، اعتبر الوديعُ صك باكستان صكاً نافذ المفعول في الحال بصرف النظر عما تنص عليه الفقرة 4 (ج) من المادة 20 من اتفاقية فيينا لعام 1969.

Pakistan's instrument is therefore considered by the depositary as taking immediate effect, notwithstanding article 20, paragraph 4 (c), of the 1969 Vienna Convention.
ومن ثم، اعتبر الوديعُ صك باكستان صكا تترتب عليه آثار فورية بصرف النظر عما تنص عليه الفقرة 4 (ج) من المادة 20 من اتفاقية فيينا لعام 1969.

3 - بصرف النظر عما تنص عليه الفقرة 2 من هذه المادة يجوز، في إجراءات الإعسار التي تبدأ في دولة غير الدولة التي يقع فيها مقر المحيل، وبصرف النظر عما تنص عليه الفقرة 1 من هذه المادة، إعطاء الأولوية لأي حق تفضيلي يَنشأ، إعمالا للقانون، بمقتضى قانون دولة المحكمة وتُعطى له الأولوية على حقوق محال إليه في إجراءات الإعسار التي تُنظم بمقتضى قانون تلك الدولة.
