٢٤ - واقترح أيضا الاستعاضة عن عبارة " خطر التسبب بضرر جسيم " بعبارة " خطر جسيم بإحداث ضرر عابر للحدود " ، ذلك أنه رئي أن الصيغة السابقة تطمس بما لا داعي له العلاقة القانونية الدقيقة القائمة بين العناصر الحاسمة لمخاطر الحدث الضار واحتمال حدوثه وعواقبه.

٣٤ - وانتقل إلى المادة ٧ فقال إن حكومات كثيرة تستفسر عن العلاقة بين المادة ٥ المعنونة " الانتفاع والمشاركة المنصفان والمعقولان " والمادة ٧ المعنونة " الالتزام بعدم التسبب بضرر جسيم " .
