Canada), the Committee recalled that States parties had the obligation not to expose individuals to a real risk of being killed or subjected to torture or cruel, inhuman or degrading treatment or punishment upon return to another country by way of their extradition, expulsion or refoulement.

(c) To exercise restraint in respect of so-called diplomatic assurances provided by the receiving State not to subject a person to torture or other inhuman treatment, as this can never replace the removing State's obligation to carry out an individual assessment of whether a real risk of torture or cruel, inhuman or degrading treatment or punishment exists in respect of the person;
