24. Bearing in mind the analysis put forward in the first report on this topic, as well as the contributions from States, it seems appropriate to accept the premise that the provisional application of treaties has legal effects, although this should not be interpreted as a simplified form of entry into force of the treaty or of some of its provisions.

While the intention of the parties was relevant for interpretation of a treaty, such intention was to be determined from its text and from the context in which it had been adopted. All other relevant circumstances should be taken into account in order to determine whether the treaty or some of its provisions could continue to be in force during armed conflict and ascertain the legality of the actions of each of the belligerents.
وفي ضوء أهمية نية الأطراف لتفسير معاهدة ما، فإن هذه النية لا بد من تحديدها من واقع نص المعاهدة ومن السياق الذي يتم خلاله اعتمادها مع مراعاة جميع الظروف ذات الصلة بما يتيح البتّ فيما إذا كانت المعاهدة أو بعض من أحكامها يمكن استمرار العمل بها خلال النزاع المسلح مع تأكيد قانونية الإجراءات التي يتخذها كلٌ من الأطراف المتحاربة.
