How, for instance, can the carrier be permitted to issue a transport document that is not covered by the contract of carriage without being under obligation to carry the goods and consequently having the same period of responsibility as the period of the contract of carriage?
فكيف نُجيز للناقل أن يُصدر مستند نقل غير مشمول بعقد النقل ودون أن يتحمل واجب نقل البضاعة، ثم نطبّق عليه مدة الالتزام بعقد النقل؟

How can the carrier be permitted to issue a transport document that is not covered by the contract of carriage and in respect of which it does not assume the obligation to carry the goods and apply to it a period of responsibility for the contract of carriage?
إذ كيف نجيز للناقل أن يُصدر مستند نقل غير مشمول بعقد النقل ودون أن يتحمل واجب نقل البضاعة ومن ثم نطبّق عليه مدة الالتزام بعقد النقل؟

It was also said that a registered owner could not be said to be totally unrelated to the contract of carriage, since the owner of a ship should be expected to take interest in the purposes for which the ship was used.
وذكر أيضا أنه من غير الممكن القول بأن المالك المسجل لا شأن لـه بعقد النقل بتاتا لأن المتوقع من صاحب السفينة أن يهتم بالأغراض التي تستخدم فيها سفينته.

However, if the circumstances so indicate, the risk is assumed by the buyer from the time the goods were handed over to the carrier who issued the documents embodying the contract of carriage.

2٣- تعني " تفاصيل العقد " ما يرد في مستند النقل أو سجل النقل الإلكتروني من معلومات تتعلق بعقد النقل أو بالبضاعة (بما في ذلك شروط العقد والترميزات والتوقيعات والتظهيرات).

In addition, it was observed that problems could arise with respect to the provision in draft article 43 that the transport document was prima facie evidence of the carrier's receipt of the goods if the transport document could include specified transport that was not covered by the contract of carriage.

وإذا ما تولى الناقل ترتيبات النقل غير المشمول بعقد النقل حسبما ينص عليه مستند النقل أو سجل النقل الإلكتروني ذلك، فهو يفعل ذلك نيابة عن الشاحن. "

Further, it was agreed that the second sentence should be replaced with the following clearer text: " In such event, the carrier's period of responsibility is only the period covered by the contract of carriage " .
كما اتُّفق على أن يستعاض عن الجملة الثانية بالنص الأوضح التالي: " وفي تلك الحالة، تكون مدة التزام الناقل هي المدة المشمولة بعقد النقل فحسب " .

The current wording " ..., the carrier may agree to issue a single transport document or electronic transport record that includes specified transport that is not covered by the contract of carriage ... " would allow a transport document and the contract of carriage to indicate different modes of carriage.
فالصيغة الحالية التي تنص على أنه " يجوز للناقل أن يوافق، 000، على إصدار مستند نقل واحد أو سجل نقل إلكتروني واحد يتضمن نقلا محددا غير مشمول بعقد النقل 000 " ستتيح لمستند النقل ولعقد النقل أن يشيروا إلى وسائط نقل مختلفة.
