Yet, one of the main problems concerning unaccompanied aliens remained: if their legal status could not be settled, they could be deported to their country of origin.
إلا أن أحد أهم المشاكل التي تعترض الأجانب غير المصحوبين قد ظل قائماً: ففي حال عدم تسوية الوضع القانوني لهؤلاء الأطفال، فإنهم يُطردون إلى بلدهم المنشأ.

50. Unaccompanied or separated children in a country outside their country of origin are particularly vulnerable to exploitation and abuse.
50- الأطفال غير المصحوبين أو المنفصلون عن ذويهم الموجودون في بلد غير بلدهم المنشأ معرضون بوجه خاص للاستغلال والإيذاء.

Children who are at risk of being re-trafficked should not be returned to their country of origin unless it is in their best interests and appropriate measures for their protection have been taken.
ولا يجوز إعادة الأطفال المعرضين لخطر الاتجار بهم مجدداً إلى بلدهم المنشأ إلا إذا كان هذا التدبير متماشياً مع مصالحهم الفضلى واتُّخذت التدابير الملائمة لضمان حمايتهم.

General comment No. 6 on the treatment of unaccompanied and separated children outside their country of origin (CRC/GC/2005/6), which was adopted during the Committee's thirty-ninth session (see annex II); and

40. Mechanisms established under national law in order to ensure alternative care for such children in accordance with article 22 of the Convention, shall also cover unaccompanied or separated children outside their country of origin.
40- وينبغي للآليات المنشأة بموجب القانون الوطني بغية ضمان الرعاية البديلة لهؤلاء الأطفال وفقاً لأحكام المادة 22 من الاتفاقية، أيضاً أن تشمل الأطفال غير المصحوبين أو المنفصلين عن ذويهم الموجودين خارج بلدهم المنشأ.

To allow for a well-informed expression of such views and wishes, it is imperative that such children are provided with all relevant information concerning, for example, their entitlements, services available including means of communication, the asylum process, family tracing and the situation in their country of origin (arts. 13, 17 and 22 (2)).
وكيما يتمكن هؤلاء الأطفال من إبداء آرائهم ورغباتهم عن دراية، لا بد أن تقدَّم إليهم جميع المعلومات المهمة ذات الصلة بأمور منها على سبيل المثال مستحقاتهم والخدمات المتاحة بما فيها وسائل الاتصال، وعملية طلب اللجوء، والبحث عن أفراد الأسرة، والحالة في بلدهم المنشأ (المواد 13 و17 و22(2)).

(c) Take all measures to guarantee protection of refugee children in line with international human rights and refugee law, while taking into account the Committee's general comment No. 6 (2005) on the treatment of unaccompanied and separated children outside their country of origin.
(ج) اتخاذ كافة التدابير اللازمة لضمان حماية الأطفال اللاجئين وفقاً لأحكام القانون الدولي لحقوق الإنسان وقانون اللاجئين، مع مراعاة تعليق اللجنة العام رقم 6(2005) بشأن معاملة الأطفال غير المصحوبين والمنفصلين عن ذويهم خارج بلدهم المنشأ.

The Committee urges the State party to take all measures to guarantee the protection of refugee children in line with international human rights and refugee law, while taking into account the Committee's general comment No. 6 (2005) on the treatment of unaccompanied and separated children outside their country of origin.
70- تحث اللجنة الدولة الطرف على اتخاذ جميع التدابير اللازمة لضمان حماية الأطفال اللاجئين وفقاً لأحكام القانون الدولي لحقوق الإنسان وقانون اللاجئين، مع مراعاة تعليق اللجنة العام رقم 6(2005) بشأن معاملة الأطفال غير المصحوبين والمنفصلين عن ذويهم خارج بلدهم المنشأ.
