Concerning measures to permit their courts or competent authorities to recognize another State party's claim of legitimate ownership of property proceeds of crime, as prescribed by paragraph (c), Armenia, Azerbaijan and Hungary reported partial implementation of such measures.

وفيما يتعلق بتنفيذ تدابير تأذن لمحاكم الدولة الطرف أو لسلطاتها المختصة بأن تعترف بمطالبة دولة طرف أخرى بالملكية المشروعة لعائدات الجريمة (الفقرة (ج) من المادة 53)، أشارت اليونان أيضا إلى لجنتها المعنية بالصياغة التشريعية.

Angola, Kenya, Mauritania, Mauritius, Morocco and Uganda reported no adoption of measures to permit their courts to recognize another State party's claim as a legitimate owner of property acquired through the commission of an offence of corruption (para. (c)), while Sierra Leone indicated that its legislation was partially compliant with the provision under review.
وأبلغت أنغولا وكينيا وموريتانيا وموريشيوس والمغرب وأوغندا عن عدم اعتماد تدابير تأذن لمحاكمها بأن تعترف بمطالبة دولة طرف أخرى بممتلكات اكتسبت بارتكاب جريمة الفساد، باعتبارها مالكة شرعية لها (الفقرة (ج))، في حين ذكرت سيراليون أن تشريعاتها تمتثل امتثالا جزئيا للأحكام قيد الاستعراض.

With regard to the adoption of measures to permit its courts or competent authorities to recognize another State party's claim of legitimate ownership of property that is the proceeds of crime (subpara. (c)), Azerbaijan reported no need for specific technical assistance to overcome its partial compliance.

Cuba reported no implementation of measures permitting courts or competent authorities to recognize another State party's claim of legitimate ownership of property acquired with the proceeds of crime as set forth in subparagraph (c) of article 53, thereby not complying with an obligatory reporting item.
107- أفادت كوبا بعدم تنفيذ التدابير التي تسمح للمحاكم أو السلطات المختصة بأن تعترف بمطالبة دولة طرف أخرى بممتلكات اكتسبت من عائدات الجريمة باعتبارها مالكة شرعية لها، على النحو المبيّن في الفقرة (ج) من المادة 53، ومن ثَم لم تمتثل لأحد بنود الإبلاغ الإلزامية.

In application of paragraph (c), Mongolia and Pakistan stated that their courts or competent authorities had permission to recognize another State party's claim of legitimate ownership of property proceeds of crime, and thus reported full compliance with the provision under review.
وتطبيقاً لأحكام الفقرة (ج)، ذكرت باكستان ومنغوليا أيضاً أنه يؤذن لمحاكمها أو سلطاتهما المختصة بالاعتراف بمطالبة دولة طرف أخرى بممتلكات اكتسبت بارتكاب فعل مجرم باعتبارها مالكة شرعية لها، وأبلغتا بذلك عن امتثالهما الكامل للحكم قيد الاستعراض.

However, Cuba did not provide information on paragraph (c), concerning the ability of courts or competent authorities to recognize another State party's claim of legitimate ownership of property proceeds of crime, thereby not complying with an obligatory reporting item.

With regard to measures to permit courts or competent authorities to recognize another State party's claim of legitimate ownership of property proceeds of crime, as prescribed by paragraph (c), Angola, Kenya, Mauritania and Uganda reported that they had not implemented such measures, while Mauritius and Sierra Leone reported partial compliance with the provision and cited relevant legislation.

The United Republic of Tanzania indicated partial adoption of measures to permit its courts to order those who had committed offences of corruption to pay compensation to another State party harmed by such offences (art. 53, subpara. (b)) and of measures to permit its courts to recognize another State party's claim as a legitimate owner of property acquired through the commission of an offence of corruption (art. 53, subpara. (c)).

All reporting parties except Lithuania, the Russian Federation (both stated partial compliance) and the former Yugoslav Republic of Macedonia (no compliance) reported full implementation of measures to permit domestic courts to recognize another State party's claim as a legitimate owner of property acquired through the commission of an offence of corruption (art. 53, subpara. (c)).

However, they did not substantiate their answers by providing examples of successful implementation (an optional reporting item). Morocco reported full compliance with the article under review, with the exception of paragraph (c), providing for domestic courts or competent authorities to recognize another State party's claim of legitimate ownership of property proceeds of crime, in respect of which it assessed its legislation as non-compliant.
