Article 246: The Yemeni courts shall have competence to try any Yemeni who commits a legally designated offence abroad, where the offender then returns to the Republic and the offence is punishable under the law of the State in which it was committed.
المادة 246: تختص المحاكم اليمنية بمحاكمة كل يمني ارتكب خارج إقليم الدولة فعلاً يعد بمقتضى القانون جريمة إذا عاد إلى الجمهورية وكان الفعل معاقباً عليه بمقتضى قانون الدولة الذي ارتكبت فيه.

تختص المحاكم اليمنية بمحاكمة كل يمني ارتكب خارج إقليم الدولة فعلاً يعد بمقتضى القانون جريمة إذا عاد إلى الجمهورية وكان الفعل معاقباً عليه بمقتضى قانون الدولة الذي ارتكبت فيه.

Any Sudanese national who, while abroad, commits an act that makes him the author of, or an accomplice to, an offence under this code shall be liable to punishment, if he returns to the Sudan and the act constitutes an offence under the law of the State in which it was committed, unless the person was tried before a competent court outside the Sudan and served his sentence or was acquitted.
يعاقب كل سوداني ارتكب وهو في الخارج، فعلاً يجعله فاعلاً أصلياً أو شريكاً في جريمة بمقتضى أحكام هذا القانون إذا عاد إلى السودان وكان الفعل يشكل جريمة بمقتضى قانون الدولة التي وقع فيها، ما لم يثبت أنه قد حوكم أمام محكمة مختصة خارج السودان، واستوفى عقوبته أو برأته تلك المحكمة.

Responses showed that the authentication could be done by the Consul of the State where enforcement was sought, or where the award was made, a court of the State where the award was made or, officials authorized by the law of the State where the award was made.
54- وتبيّن من الردود أن التصديق يمكن أن يقوم به قنصل الدولة التي التمس فيها الإنفاذ، أو التي صدر فيها قرار التحكيم أو محكمة تابعة للدولة التي صدر فيها قرار التحكيم أو موظفون مأذون لهم بذلك بمقتضى قانون الدولة التي صدر فيها قرار التحكيم.

69. This Code applies to anyone who commits in the Sudan an act that contributes to an offence committed outside the Sudan and is regarded as an offence both in the Sudan and under the law of the State in which it is committed.
69- تسري أحكام هذا القانون على كل شخص يرتكب في السودان فعلاً مشتركاً في فعل يرتكب خارج السودان، يعد جريمة في السودان وجريمة بمقتضى قانون الدولة التي وقع فيها.

“(a) the claim is secured by a maritime lien recognized under the law of the State where the arrest is made;
" )أ( إذا كان الادعاء مضموناً بامتياز بحري معترف به بمقتضى قانون الدولة التي يوقع فيها الحجز؛

The status and powers that a body has under the law of the State in question are obviously relevant in determining whether that body is an “organ” of the State.
ومن الجلي أن للصفة والسلطات التي تتمتع بها الهيئة بمقتضى قانون الدولة المعنية صلة بتحديد ما إذا كانت هذه الهيئة " جهازا " من أجهزة الدولة.

By definition, these entities are not part of the formal structure of the State, but they exercise governmental authority in some respect; the usual and obvious basis for that exercise will be a delegation or authorization by or under the law of the State.
إن هذه الكيانات ليست، بحكم تعريفها، جزءا من البنية الرسمية للدولة، ولكنها تمارس سلطة حكومية من بعض الوجوه؛ واﻷساس الاعتيادي والواضح الذي تستند إليه هذه الممارسة هو إما تفويض أو ترخيص بمقتضى قانون الدولة أو في إطاره.

(b) Make lawful the acquisition of property rights in real estate not permitted under the law of the State where the real estate is located.
(ب) أن تضفي الصفة القانونية على حيازة حقوق الملكية في عقار لا يُسمح بها بمقتضى قانون الدولة التي يوجد فيها العقار.

(a) the claim is secured by a maritime lien recognized under the law of the State where the arrest is made;
)أ( إذا كانت المطالبة مضمونة بامتياز بحري معترف به بمقتضى قانون الدولة التي يوقع فيها الحجز؛

The law should in addition provide that a security right in intellectual property may also be created under the law of the State in which the grantor is located and may also be made effective under that law against third parties other than another secured creditor, a transferee or a licensee.
وينبغي إلى جانب ذلك أن ينص القانون على جواز إنشاء الحق الضماني في الممتلكات الفكرية أيضا بمقتضى قانون الدولة التي بها مقر المانح وجعله نافذا بمقتضى ذلك القانون تجاه الأطراف الثالثة بخلاف أي دائن مضمون آخر أو الطرف الذي تنقل إليه ملكيتها أو الطرف المرخص له باستخدامها.

(b) In any other case, under the law of the State where the buyer has his place of business.
(ب) في أي حالة أخرى بمقتضى قانون الدولة التي يوجد فيها مكان عمل المشتري.

2. Add the following phrase at the end of paragraph 2: " or other documents which are enforceable under the law of the State where such measures have been taken " .
٢- تضاف العبارة التالية إلى آخر الفقرة ٢: " أو ﻷية مستندات واجبة النفاذ بمقتضى قانون الدولة التي اتخذت فيها مثل هذه التدابير " .

" Arrest " means the detention of a ship by judicial process to secure maritime claim, but does not include the seizure of a ship in execution or satisfaction of a judgement or other documents which are enforceable under the law of the State where such measures have been taken.
" الحجز " يعني احتجاز سفينة بإجراء قضائي لضمان مطالبة بحرية، ولكنه لا يشمل الاستيلاء على سفينة تنفيذاً أو تلبية لحكم أو لمستندات أخرى واجبة النفاذ بمقتضى قانون الدولة التي اتخذت فيها مثل هذه اﻹجراءات.

Therefore, the seizure of a ship based on the documents which are enforceable in the same way as judgements under the law of the State should be excluded from the definition of " Arrest " .
وبالتالي، فإن الاستيلاء على السفينة استناداً إلى مستندات واجبة النفاذ على غرار اﻷحكام التي تتخذ بمقتضى قانون الدولة ينبغي أن يستبعد من تعريف " الحجز " .

(a) under the law of the State where the goods will be resold or otherwise used, if it was contemplated by the parties at the time of the conclusion of the contract that the goods would be resold or otherwise used in that State; or
(أ) بمقتضى قانون الدولة التي سيعاد فيها بيع البضائع أو استخدامها بطريقة أخرى إذا كان قصد الطرفان وقت إبرام العقد إعادة بيع البضائع أو استخدامها بطريقة أخرى في تلك الدولة؛ أو

71. Any Sudanese who commits, while abroad, an act that renders him the author of, or an accomplice to, a crime under the terms of this Code, shall be subject to punishment, if that person returns to the Sudan and the act constitutes an offence under the law of the State in which it was committed, unless the person was tried before a competent court outside the Sudan and served his sentence or was acquitted.
71- يعاقب كل سوداني ارتكب، وهو في الخارج، فعلاً يجعله فاعلاً أصلياً أو شريكاً في جريمة بمقتضى أحكام هذا القانون إذا عاد إلى السودان وكان الفعل يشكل جريمة بمقتضى قانون الدولة التي وقع فيها، ما لم يثبت أنه قد حوكم أمام محكمة مختصة خارج السودان واستوفى عقوبته أو برأته تلك المحكمة.

25. The commercial reservation restricts the field of application of the New York Convention by permitting States to only provide recognition and enforcement of arbitral awards that pertain to differences arising out of legal relationships considered as commercial under the law of the State, which made the reservation.
25- يقيّد التحفظ التجاري نطاق انطباق اتفاقية نيويورك، إذ لا يسمح بمنح الاعتراف والإنفاذ إلا لقرارات التحكيم المتصلة بالخلافات الناشئة عن العلاقات القانونية التي تُعتَبر تجارية بمقتضى قانون الدولة التي قدمت التحفظ.

Crimes committed abroad by Austrian nationals irrespective of their status as Austrian civil servants are punishable under Austrian law only if they are punishable under the law of the State where they were committed.
والجرائم التي يرتكبها في الخارج رعايا نمساويون، بصرف النظر عن مركزهم كموظفين مدنيين نمساويين، لا يعاقب عليها القانون النمساوي إلا إذا كانت تستتبع العقوبة بمقتضى قانون الدولة التي ارتكبت فيها الجرائم().

The regulation should provide that [the person authorized by the enacting State or by the law of the enacting State] appoints the registrar, determines the registrar's duties and monitors the registrar's performance.
ينبغي أن تنص اللائحة التنظيمية على أنَّ [الشخص المأذون له من جانب الدولة المشترعة، أو بمقتضى قانون الدولة المشترعة] هو الذي يُعيِّن أمين السجل ويحدِّد واجباته ويراقب أداءه.
