It was pointed out that the publication of information pertaining to arbitration under the UNCITRAL Arbitration Rules could be handled by the UNCITRAL secretariat and posted on its website.
وذُكر أنه يمكن لأمانة الأونسيترال أن تتولى نشر المعلومات المتعلقة بعمليات التحكيم التي تنظّم بمقتضى قواعد الأونسيترال للتحكيم وأن تنشر تلك المعلومات في موقعها الشبكي.

29- ويجوز للمؤسسة الراغبة في العمل كمؤسسة تعيين بمقتضى قواعد الأونسيترال للتحكيم أن تبيِّن في إجراءاتها الإدارية شتى وظائف سلطة التعيين المتوخّاة في هذه القواعد.

The present note contains under section II the text of draft recommendations to assist arbitral institutions and other interested bodies with regard to arbitration under the UNCITRAL Arbitration Rules, as revised in 2010.
3- وتتضمَّن هذه المذكرة في بابها الثاني نص مشروع التوصيات لمساعدة مؤسسات التحكيم وغيرها من الهيئات المهتمة فيما يخص التحكيم بمقتضى قواعد الأونسيترال للتحكيم بصيغتها المنقَّحة في عام 2010.

II. Arbitral institutions and other interested bodies administering arbitration under the UNCITRAL Arbitration Rules or providing some administrative services
ثانياً- مؤسسات التحكيم والهيئات المهتمة الأخرى التي تدير التحكيم بمقتضى قواعد الأونسيترال للتحكيم أو تقدم بعض الخدمات الإدارية

In this respect it was agreed that any solution offered under article 1 should not undermine any discretion which tribunals otherwise have under the UNCITRAL Arbitration Rules 2010.
136- واتُّفق، في هذا الشأن، على أنه لا ينبغي لأيِّ حل يقدَّم بمقتضى المادة 1 أن يمس بالصلاحية التقديرية التي تتمتع بها المحاكم بمقتضى قواعد الأونسيترال للتحكيم لعام 2010.

It was said that the material scope of application related to the question whether the rules on transparency would apply in the context of arbitration initiated under the UNCITRAL Arbitration Rules only, or also to arbitration conducted under other rules if the parties so chose.
وقيل إنَّ النطاق المادي للتطبيق، الذي يتعلق بمسألة ما إذا كانت قواعد الشفافية ستُطبّق في سياق عمليات التحكيم التي تُستَهل بمقتضى قواعد الأونسيترال للتحكيم فقط، أو أيضاً على عمليات التحكيم التي تجري بمقتضى قواعد أخرى إذا اختار الطرفان ذلك.

It was underlined that if the rules on transparency were to be applied only to arbitration under the UNCITRAL Arbitration Rules, that would permit an investor to choose to arbitrate under a different set of arbitration rules that did not include any transparency provisions.
وشُدِّد على أنه إذا طُبقت قواعد الشفافية على عمليات التحكيم بمقتضى قواعد الأونسيترال للتحكيم فقط، فمن شأن ذلك أن يتيح للمستثمر أن يختار إجراء التحكيم بمقتضى مجموعة قواعد تحكيم مغايرة لا تتضمن أيَّ أحكام بشأن الشفافية.
