The commentary made it clear that the articles were in all respects to be interpreted in conformity with the Charter of the United Nations, and that the principle under Article 103 of the Charter that in the event of a conflict between the obligations under the Charter and obligations under any other international agreement, the obligations under the Charter should prevail.
والتعليق يجعل من الواضح أن المواد يجب أن تُفَسَّر من جميع نواحيها بما يتفق مع ميثاق الأمم المتحدة، وذلك من حيث أن المادة 103 من الميثاق تقضي بأنه في حال تعارض الإلتزامات المرتبط بها بموجب الميثاق مع الإلتزامات المرتبط بها بموجب أي اتفاق دولي آخر فالعبرة هي بالإلتزامات المترتبة على الميثاق.

A State shall not, however, be entitled to present a claim under this Convention in respect of the same damage for which a claim is being pursued in the courts or administrative tribunals or agencies of a launching State or under another international agreement which is binding on the States concerned.
بيد أنه لا يحق لأية دولة أن تقدم، بموجب هذه الاتفاقية أو بموجب أي اتفاق دولي آخر ملزم للدول المعنية، مطالبة بالتعويض عن أضرار رفعت بشأنها دعوى لدى المحاكم القضائية للدولة المطلقة أو لدى محاكمها أو هيئاتها الإدارية.

وهذا ما ينطبق على المادة 103 من ميثاق الأمم المتحدة التي تنص على أنه " إذا كان هناك تعارض بين الالتزامات المترتبة على أعضاء الأمم المتحدة بموجب الميثاق والالتزامات المترتبة عليهم بموجب أي اتفاق دولي آخر فالأسبقية للالتزامات المترتبة عليهم بموجب هذا الميثاق " .

145. Thus, the drafters of the Charter made it absolutely clear that obligations taken in application of Chapter VII shall prevail over obligations under any other international agreement.
145 - وهكذا، فواضعوا مشروع الميثاق أوضحوا بشكل كامل أن الالتزامات المترتبة عن تطبيق الفصل السابع() تسمو على سواها من الالتزامات المترتبة بموجب أي اتفاق دولي آخر().
