The " bright line " rule reflected in Article 1(2) was included to distinguish the application of the Rules on Transparency under existing treaties (opt-in) from the application of the Rules under future treaties (opt-out), in both cases where investor-State arbitration is initiated under the UNCITRAL Arbitration Rules.
وإن قاعدة " الخط الجلي " التي تعكسها المادة 1 (2) قد أدرجت للتمييز بين تطبيق قواعد الشفافية بموجب المعاهدات القائمة (خيار التطبيق) عن تطبيق القواعد بموجب معاهدات مقبلة (خيار عدم التطبيق)، في كلتا الحالتين اللتين يستهل فيهما التحكيم بين المستثمرين والدول بمقتضى قواعد الأونسيترال للتحكيم.

With a view to enhancing certainty as to the applicability of the rules on transparency with respect to existing treaties, various suggestions were made, including unilateral declarations by Governments, a joint interpretation by Governments, an instrument open to signature or ratification whereby States could express consent or agree to apply the transparency rules under existing treaties.
93- وبغية تعزيز التيقُّن بشأن انطباق قواعد الشفافية فيما يتعلّق بالمعاهدات القائمة، قُدِّمت اقتراحات مختلفة، منها إعلانات أُحادية تُصدرها الحكومات، أو تفسير تشترك الحكومات في إعداده، أو صك مفتوح للتوقيع أو التصديق عليه حيث يمكن للدول أن تبدي قبولها بتطبيق قواعد الشفافية بموجب المعاهدات القائمة أو توافق على ذلك.

Our primary reservation concerning this new treaty remains with regard to article 12, which indicates that existing treaty obligations of the States party would not be affected by this new Treaty on a Nuclear-Weapon-Free Zone.
وتحفظنا الأساسي بالنسبة لهذه المعاهدة الجديدة ما زال يتعلق بالمادة 12، التي تنص على أن التزامات الدول الأطراف بموجب المعاهدات القائمة لن تتأثر بهذه المعاهدة الجديدة بشأن المنطقة الخالية من الأسلحة النووية.
