ويعتبر وفد بلدي أن الاجراءات المحددة بموجب اﻵلية منصفة ومتوازنة.

33. With regard to the crime of aggression, two problems arose: the lack of a precise definition, and the fact that under the mechanism established in article 23 of the draft statute the court could initiate prosecution for that crime only if the Security Council had made a prior determination that a State had committed aggression.
٣٣ ـ وفيما يتعلق بجريمة العدوان، قال إن مشكلتين تنشآن في شأنها: عدم وجود تعريف دقيق لها، وأن المحكمة لا تستطيع، بموجب اﻵلية التي تقررها المادة ٢٣ من مشروع النظام اﻷساسي، أن تحرك اجراءات الدعوى الجنائية إلا اذا كان مجلس اﻷمن قد صدر عنه قرار سابق حدد فيه أن دولة قد ارتكبت العدوان.

10. If an item, the import of which should have been notified under the mechanism but was not, is found in Iraq, the import would constitute a case of non-compliance with the monitoring regime established by the plans for ongoing monitoring and verification.
١٠ - وإذا وجد في العراق صنفا كان ينبغي الاخطار باستيراده بموجب اﻵلية ولم يخطر به، شكﱠل استيراده حالة عدم امتثال لنظام الرصد المنشأ بخطتي الرصد والتحقق المستمرين.

8. Each Government shall determine what measures it has to take to give effect internally to the notification requirements under the mechanism (e.g. requiring national licences).
٨ - وعلى كـل حكومـة أن تحـدد التدابير التـي يجب عليها اتخاذها مـن أجـل الانفاذ الداخلـي لشروط اﻹخطار المفروضة بموجب اﻵلية )فرض إجازات وطنية مثلا(.

“15. Demands that Iraq meet unconditionally all its obligations under the mechanism approved by this resolution and cooperate fully with the Special Commission and the Director General of the International Atomic Energy Agency in the carrying out of their tasks under this resolution and the mechanism by such means as they may determine in accordance with their mandates from the Council;
" ١٥ - يطالب بأن يفي العراق، دون قيد أو شرط، بجميع التزاماته المقررة بموجب اﻵلية الموافق عليها بموجب هذا القرار، وأن يتعاون تماما مع اللجنة الخاصة والمدير العام للوكالة الدولية للطاقة الذرية في تنفيذ مهامهما المقررة بموجب هذا القرار واﻵلية بالوسائل التي يحددانها وفقا لولايتيهما الصادرتين من المجلس؛

15. Demands that Iraq meet unconditionally all its obligations under the mechanism approved by this resolution and cooperate fully with the Special Commission and the Director General of the IAEA in the carrying out of their tasks under this resolution and the mechanism by such means as they may determine in accordance with their mandates from the Council;
١٥ - يطالب بأن يفي العراق، دون قيد أو شرط، بجميع التزاماته المقررة بموجب اﻵلية الموافق عليها بموجب هذا القرار، وأن يتعاون تماما مع اللجنة الخاصة والمدير العام للوكالة الدولية للطاقة الذرية في تنفيذ مهامهما المقررة بموجب هذا القرار واﻵلية بالوسائل التي يحددانها وفقا لولايتيهما الصادرتين من المجلس؛

Inspections under the mechanism will take place not only at the declared end-user sites, where notified items will be tagged, as appropriate, and entered into the site protocols, but will also be conducted anywhere else in Iraq where there is reason to believe that notified items or dual-use items in respect of which there should have been notification may be found.
وستجري عمليات التفتيش بموجب اﻵلية لا في مواقع الاستخدام النهائي المعلنة فحسب حيث ستوضع علامات على البنود المبلغ عنها، حسب الاقتضاء، وتسجل في بروتوكولات الموقع، بل ستجري أيضا في أي مكان آخر بالعراق حيث توجد مدعاة للاعتقاد بأن بنودا مبلغا عنها أو ذات استخدام مزدوج وكان يتعين اﻹبلاغ عنها، قد يتم العثور عليها.
